Not trying to be ignorant but a lot of you are misinformed.

Legally, they can search you at school because you signed giving them permission or your parents did. You are probably saying no, but you did. When you sign that slip in the beginning of the year saying you understand the rules or whatever, your giving access to all your shit being searched.

They legally can pat you down, they cannot search you though. They can only search for weapons, NOT drugs. If they feel a dime bag in your pocket they legally cant take it out, say its a peice of candy, if it doesnt feel like a weapon they cant do shit.

When denying a search you must be very clear, if the police officer says "Do you mind if I search your car?" and you are just immiedtly saying no to it without thinking, you just said you dont mind, that gives them permission. You cant take that back, if you resist they can haul your ass out of the car and cuff you up.

Do you mind if I search your car? Is often INTERPERTED to mean "Can I search your car?" and is usually answered like the second question. But, technically, if you DON'T mind... then they can do it.

I disagree with the original comment anyway though.

You can ALWAYS at any time remove your permission for them to search.

Just say, "Okay, you've looked enough. I'm not giving you permission to search any more. I've got things to do." Or whatever you want. You don't even need to be suave about it (although acting scared is going to cause them to WANT to search more and they might not stop). Legally, when you tell them they can no longer search, they have to stop searching. Your permission extends only as far as you want.

Ah, I was misreading it, thanks. That's interesting that you can revoke your permission and make them stop. I didn't think you could do that.

Yep, as long as you inform them that you withdraw consent before they stumble onto something illegal. If they pull the door to your grow-room half open before you say stop... and the smell of weed wafts out... they have probably cause to continue the search.

It does become progressively harder to get them to stop once you have given consent and it is ALWAYS the best idea to refuse it from the start. But if you give consent and halfway through them searching your front seat you remember you have an eighth stuffed in the toe of an old pair of sneakers in the back seat ... then it would be extremely important to withdraw your permission ASAP. If the cop continues to search and finds something (after you have removed consent and when they have no further probable cause) the evidence will most likely be thrown out.

You can refuse the search for many reasons... especially the primary 4th ammendment one that we already know. But, your right is further supported by the rights you have against police harrassment and unlawful detention. If you could not legally revoke your permission... then the cop could detain you for 10 hours while he went over every inch of your car five times in a row (just to piss you off or if he doesn't like something about you... perhaps that Phish bumpersticker).

Are cops really more likely to search/hassle people with certain bumperstickers like phish or grateful dead etc.?

In my, admittedly limited, experience -- yes. The cops who are out fishing are going to search people that fit certain molds. I bought my VW Bus from a guy who was tired of being pulled over and searched once a month. He bought a newish Honda and hasn't been pulled over since.

I have a bunch of music stickers on my car. I've been pulled over three times in the last 6 months (nothing stuck). Most of the stops were BS -- in one a cop waved me through a stop sign after I had come to a complete stop and then pulled me over for running the stop sign. But I was polite, kept my cool, and didn't give them a reason to even ask to search. Only once was there anything in the car... but still... it was scary each time.

I have seen my mom get pulled over and she gets 1/10th of the questions I do. And I don't have long hair or wear my tye-dye in public anymore. That is just the stickers on my car -- in my opinion.

So I would say that yeah it makes a difference. Especially when cops are looking to bust someone. They are going to be looking for the most likely catches.
