There doesn't appear to be any compelling legal reason why Merchan can't sentence Trump. He was convicted in the NY hush money case in May 2024. He was scheduled to be sentenced in July a few days before the RNC convention. It was delayed until September. The sentencing was delayed again until November after the election to not give the impressio of being political. Merchan delayed it again and without any reschedule date.
The arguments by Trump team for not sentencing are becoming increasingly far-fetched. The latest is that Trump supposedly has immunity as president-elect. Immunity not just to delay sentencing but to vacate the conviction itself. Trump's team has also argued that the sentencing shouldn't happen until he has gone through a full appeal of the conviction. Judge Merchan seems like he's not sure how to proceed with the case, but he has stated that he won't vacate the conviction.
