Lawyer Who Plotted to Overturn Trump Loss Recruits Election Deniers to Watch Over the Vote

    excerpt:

"“We are taking the lessons we learned in 2020 and we are going forward to make sure they never happen again,” Ms. Mitchell told the crowd of about 150 activists-in-training.

She would be “putting you to work,” she told them.

In the days after the 2020 election, Ms. Mitchell was among a cadre of Republican lawyers who frantically compiled unsubstantiated accusations, debunked claims and an array of confusing and inconclusive eyewitness reports to build the case that the election was marred by fraud. Courts rejected the cases and election officials were unconvinced, thwarting a stunning assault on the transfer of power.

Now Ms. Mitchell is prepping for the next election. Working with a well-funded network of organizations on the right, including the Republican National Committee, she is recruiting election conspiracists into an organized cavalry of activists monitoring elections."

Lindell was a speaker at Trump's rally in Wyoming this week.

He's at nearly every Trump rally, like a virus that won't go away.

A Big Lie in a New Package

    excerpt:

"The film, directed by the conservative commentator Dinesh D’Souza, is based in part on an erroneous premise: that getting paid to deliver other people’s ballots is illegal not just in states like Pennsylvania and Georgia where True the Vote centered its research and where third-party delivery of ballots is not allowed in most cases, but in every state.

What’s more, the film claims, but never shows in its footage, that individual “mules” stuffed drop box after drop box. (Mr. Phillips said such footage exists, but Mr. D’Souza said it wasn’t included because “it’s not easy to tell from the images themselves that it is the same person.”) Those claims are purportedly backed up by tracking cellphone data, but the film’s methods of analysis have been pilloried in numerous fact-checks. (True the Vote declined to offer tangible proof — Mr. Phillips calls his methodology a “trade secret.”)"

    excerpt:

"Mr. Phillips, whose firm OpSec does data analysis for True the Vote, is perhaps best known for making a fantastical claim in 2017 that more than three million illegal immigrants voted in the 2016 election, which was amplified by Mr. Trump but never backed up with evidence. Mr. Phillips is also an adviser to Get Georgia Right, a political action committee that received $500,000 from Mr. Trump’s Save America PAC this past March 25, the day after Mr. Phillips and Ms. Engelbrecht advanced their 2020 vote-fraud theories to a legislative committee in Wisconsin. Mr. Phillips said he had “received zero money” from Get Georgia Right, which backed Mr. Trump’s favored and failed governor-primary candidate, David Perdue."

    Article from July 2021.

Supreme Court OKs 'ballot harvesting' ban amid flurry of voting laws

    excerpt:

"WASHINGTON – A divided Supreme Court on Thursday upheld a controversial Arizona law that limits how voters may return absentee ballots, weighing into a raging national debate over voting rights by curbing the landmark 1965 Voting Rights Act for the second time in less than a decade.

Associate Justice Samuel Alito wrote the opinion for a 6-3 majority, joined by the court's conservatives. Associate Justice Elena Kagan wrote a dissent for the court's liberals that framed the majority opinion as "tragic."

The case, the most significant to deal with voting rights to come before the court since 2013, dealt with two provisions of Arizona's voting law approved long before the 2020 election. State officials passed a law in 2016 barring unions and advocacy organizations from collecting voters' mail-in ballots, a practice critics call "ballot harvesting."

Another provision, which is even older, invalidates ballots cast in the wrong precinct. Neither regulation is unique to the Grand Canyon State.

The high court's opinion comes eight years after it gutted another provision of the Voting Rights Act that permitted the Justice Department to review election laws in states with a history of racial discrimination. This time, the court signaled that challenges brought under the law's nationwide prohibition on voting discrimination – though still possible – may become harder to win."

Trump and his supporters are assuming that ballots deposited by individuals who harvested them illegally would be required by state law to be thrown out.

What ‘2000 Mules’ leaves out of ballot harvesting claims

    excerpt:

"Even if there were a ballot harvesting scheme, it wouldn’t invalidate legitimate ballots just because they were turned in by unauthorized individuals. Verified ballots of registered voters still count, regardless of how they were delivered.

Election investigators have reviewed several videos included in “2000 Mules” and found no illegal behavior, including a video that showed a Gwinnett County man inserting ballots into a drop box, according to the secretary of state’s office.

“We investigated, and the five ballots that he turned in were all for himself and his family members,” said Republican Secretary of State Brad Raffensperger during a debate last week."

Peter Navarro, Former Trump Aide, Gets Grand Jury Subpoena in Jan. 6 Inquiry

    excerpt:

"Peter Navarro, who as a White House adviser to President Donald J. Trump worked to keep Mr. Trump in office after his defeat in the 2020 election, disclosed on Monday that he has been summoned to testify on Thursday to a federal grand jury and to provide prosecutors with any records he has related to the attack on the Capitol last year, including “any communications” with Mr. Trump.

The subpoena to Mr. Navarro — which he said the F.B.I. served at his house last week — seeks his testimony about materials related to the buildup to the Jan. 6 attack on the Capitol, and signals that the Justice Department investigation may be progressing to include activities of people in the White House.

Mr. Navarro revealed the existence of the subpoena in a draft of a lawsuit he said he is preparing to file against the House committee investigating the Jan. 6 attack, Speaker Nancy Pelosi and Matthew M. Graves, the U.S. attorney for the District of Columbia.

Mr. Navarro, who plans to represent himself in the suit, is hoping to persuade a federal judge to block the subpoena, which he calls the “fruit of the poisonous tree.”

The Justice Department and the U.S. Attorney’s Office declined to comment."

Trump supporter charged after frat brother gives tip to FBI.

Trump supporter arrested over US Capitol breach after fraternity brother tips off FBI

    excerpt:

"The eighth Oklahoman charged over the U.S. Capitol attack was turned in by a college fraternity brother who saw his 10 Facebook videos of the riot, the FBI reported.

Levi Roy Gable, 36, was arrested Thursday in Tulsa.

He is accused in four misdemeanor counts of illegally going inside the Capitol on Jan. 6, 2021, and engaging in disruptive conduct.

"I was among the first people to make our way into the US Capitol Building," he purportedly posted on Facebook, according to the FBI.

"Those in the building first were there in protest of Vice President Mike Pence’s statement that he would not stand with the American people and challenge the results of 2020’s stolen presidential election.""

That's a subpoena issued to Navarro originating from the DOJ, not the Jan. 6 committee.

Peter Navarro, Former Trump Aide, Gets Grand Jury Subpoena in Jan. 6 Inquiry

    excerpt:

"Mr. Navarro has refused to cooperate with the committee. He was found in contempt of Congress, and the House referred the contempt case to the Justice Department for possible criminal prosecution. In his draft lawsuit, he called the committee’s subpoena “illegal and unenforceable.”

Mr. Navarro said the grand jury subpoena was directly related to the contempt of Congress referral. Asked if he planned to comply and appear on Thursday to testify, Mr. Navarro responded, “T.B.D.”

The subpoena is the latest sign the Justice Department’s investigation into the attack has moved beyond the pro-Trump rioters who stormed the Capitol. Federal prosectors have charged more than 800 people in connection with the attack."

As expected, Sussman has been found not guilty of lying to the FBI during a verbal exchange in 2016.

Durham had a weak case from the start.

Prosecution: 'Overwhelming' evidence of guilt for Clinton campaign attorney

    excerpt:

"Prosecutors at the trial of Democratic attorney Michael Sussmann told a jury Friday that there is “overwhelming” evidence Sussmann lied to the FBI weeks before the 2016 election in order to obscure the role of the Clinton campaign in advancing allegations that then-candidate Donald Trump had a secret computer link to a Russian bank.

During closing arguments at Sussmann’s false-statement trial, special counsel John Durham’s team ridiculed the longtime cybersecurity lawyer’s claim that he was acting independently to help the FBI when he told the bureau’s top attorney of the alleged communications between a Trump server and one for Alfa Bank, the owners of which are close to Russian President Vladimir Putin."

Prosecution: 'Overwhelming' evidence of guilt for Clinton campaign attorney

    excerpt:

"The defense attributed Sussmann’s House testimony to “confusion” and argued that the whole question of whether he was or was not acting “on behalf of” the Clinton campaign or other clients is so vague that it shouldn’t be the basis for a criminal charge.

“These are not necessarily precise terms,” Berkowitz said.

Elias, the Clinton campaign’s primary attorney, made a similar comment on the witness stand last week. “‘On behalf of’ is kind of like a subjective-intent thing,” he said."

In Texas and beyond, many politicians receive mega donations from pro-gun supporters

    excerpt:

"Cruz, in particular, has taken in the most money from pro-gun individuals and groups of anyone in the current Congress, amassing $442,000 over the course of his career, according to an analysis of disclosure reports by the nonpartisan campaign finance research group OpenSecrets.

Cornyn ranks third among current U.S. senators and representatives, receiving a total of $340,000 in contributions from pro-gun donors over his career, after Rep. Steve Scalise, R-La., who has amassed $396,000, according to the analysis.

Direct contributions from pro-gun individuals and political action committees are limited to a relatively small amount each election cycle, compared to the millions of dollars that super PACs and various other unlimited-spending outside groups are allowed to spend in support of candidates independent of coordination with their campaigns. The National Rifle Association's various outside spending committees, for example, spent more than $6 million supporting North Carolina Sen. Richard Burr against unsuccessful Democratic challenger Deborah Ross during the 2016 election cycle."
