    That's what hubby told her.

They wanted to get it towed here and call the police later.

He told her you have to leave the car sitting where it happened and call police.

I'm reading that a single car accident is always going to be your fault. If you call the police they may ticket you on top of all that.

I think she is trying to avoid coming up DUI, if I know her.

Yeah... single car accident is always considered your fault. When it comes to animals, according to insurance and the cops, it's best to just hit the animal. I'm not recommending that, but that's how the law sees it.

That's what I was just reading.

Does she need a police report to file and at-fault claim?

    This is just getting deeper.

The girlfriend drove the car to a gas station and called a friend to pick her up.

Now, the cops are at the gas station checking out the car and walking around the streets near the gas station with flashlights trying to figure out what happened.

She'd had about 3 beers BUT she smoked when she got to the friends house.

I told her not to go up there until she was completely sober. I also told her to call the gas station and tell them what happened, that a friend picked her up, and she's waiting on her dad to come and a tow truck. Hopefully, the gas station employees will tell the cops and they will leave.

    Stupid shit.

    Yes... yes it is.

If it happened on public roads the cops need to be involved.

It was on a public road.

My daughter has the girlfriend now, feeding her, before she goes back to the car to wait on the wrecker.

I told her to expect to see the cops and for her to at least be ticketed for leaving the scene. Also, that the cops will want to give her sobriety tests too.

    No, she wasn't.

She's 25 years old and had been smoking. The story is she had 4 beers in a 4 or 5 hour span prior to the smoking.

Who knows if there was even a dog she supposedly swerved to miss.

I saw her drunk drive when I was on vacation with them. She was waaaaay drunk when she drove a mile or so to get a tattoo. I know she drives under the influence.

I'd advise her to not go back right now, not to tell anyone where she is and not answer any questions at all. If the car is sitting in a parking lot, there is no proof of who was driving the car, what happened to the car or when it happened. As of this moment, there is no evidence of any crime at all.....unless she starts answering questions. If they're going to get her for leaving the scene (which they can't currently prove exists) then she can let them charge her with that tomorrow when she knows she will blow a legal limit.

    Just my advice.

She hit a pole of some kind. I haven't gotten the straight of whether it was on private property or public property.

She's going to take the key to the wrecker guy.

I will tell them what you said when they get here. They are dropping off my grandson before they go to the car.

She should probably just stay somewhere and let someone else drop the key off.

She spoke to the cops by phone and told them she would be meeting them at the car. They have an open container, fleeing the scene, and damaging the county's marker pole.

She spoke to a deputy who is a family friend and he told her to stay away tonight.

She lives a couple of counties north of here and she and my daughter are going there for the night. She's turning her phone off but if the cops ping it, it will be out of county.

The wrecker driver has my daughter's address, in county, so they don't want to stay there tonight.

I don't know how the police got my daughter's phone number but right before she turned her phone off, they were calling her.

I half expect them to pull up at my house tonight. I'm not sure but I think my daughter's license still has my address on it.

You'd think that she hit another car or person or something the way the cops are ringing their phones.

I have the grandson until bus time in the morning when his mom will be back to bring him clothes.

Daughter was afraid to go back to her house, because girlfriend is in the car. She went to walmart and bought shoes and clothes for grandson to wear to school tomorrow.

The police got daughters phone number from wrecker guy. Apparently, girlfriend called wrecker from her own phone and my daughter's phone.

The police left a voice mail on my daughter's phone saying that if girlfriend didn't meet them at her car by 9:30, they'd put out a warrant for her.

Girlfriend spoke to deputy and he said that he called the police and asked them to back down until morning. So, maybe there isn't a warrant out for girlfriend yet.

They are headed across town to girlfriend's apartment.

I'll be putting grandson on the bus in the morning.

They're bluffing. And even if they aren't, if she only had 4 beers over 4-5 hours....earlier this evening? She should be fine by now. They have nothing unless she talks. They can't prove who was driving the car. If they had enough evidence to arrest her, they would come and arrest her. This is where people make a lot of mistakes and get convicted. Stop talking.

Supposedly, it'll be handled in the morning, and she will have an attorney at that time.

The police, supposedly, are going to hold off for her to come forward in the morning.

I know she will be ticketed for fleeing, open container, and damaging county property; at least she won't be getting a DUI.

Oh, she talked. By phone, she told the police that she was driving, ran off the road, drove to gas station, and had friend pick her up.

She's told them that much already.

That's too bad because that's the only evidence they have against her and she probably won't be able to get it dismissed. Had she said nothing...they have a car in a parking lot. Nothing illegal there....maybe illegal parking? At least she should be able to avoid the OWI.

There must have been a witness to her running off the road and going to the gas station; otherwise, I don't know why the police would have been checking out her car and walking down the road with flashlights. My daughter saw them when she was going to pick up girlfriend from friends house afterward. Someone saw it happen and called in, I think.
