Sounds like Funky's husband could not hire an attorney at all. Well, here in Illinois getting child support is real easy to get. All you need is to have some type of "parenting agreement" drawn-up by an attorney or both attorneys. Getting the "papers" drawn-up is hard if both "parties" cannot come to an agreement, but if the papers are filed and signed, it's no problem...................

lol.......if he is washing cars and he doesnt make much, you arent going to get much. even with the average time share of 80%/20%. you can always make a stipulation and order, but like do da said, both parties must agree and sign it.


for some strange reason, money brings out the worst in people, they get vendictive, hateful and downright sneaky. I see it everyday, (I work in Family/Criminal Law). Divorces get hella ugly. (THis is not legal advice) Usually what happens or from my experience is this,when doing this type of thing, (child support) the other party is NOT going to want to pay the other party a damn dime, thats when all of the OSC's start getting filed. (dont need a lawyer to do this, just a filing fee, and if you dont make enough you can get a fee waiver, which means that the filing of the OSC is free) most of the time there will be accusations of drug or alcohol abuse, and drug testing will be ordered by the court. A positive test usually will mean custody goes to the other parent and the parent with the positive test gets supervised visitations. (usually) Oh then of course if your state allows, minor's counsel will the be appointed for the minors. Which means that the attorney for the minors makes the custody and visitation recommendation to the Judge, etc..I guess i am just babbling.

here is a link for some child support calculations, (not exactly accurate but pretty damn close.) in the search bar but in your state ie. california child support calculator, it will then take you to a whole page of links. THe courts use a totally different program called a DissoMaster, which will configure things such as union dues, taxes stuff like that, This calculator doesnt take those things into consideration.

 

im gonna play devil's advocate and say....why not go to marriage counseling or something? just to try that first...

Yeah I agree, get marriage counselling if you can afford it. Maybe there are free services in your area, or ones that charge a fee based on your income. If it doesn't work out at least you said you gave it your best shot. My husband and I go to marriage counselling and we are having a lot of success.

If he's playing a game with you you might want to give him a taste of his own medicine and see if he likes it. For example he does nothing around the house. So why not do the same? I warn you that this will require some strength from you because he's going to taunt you and guilt you into keeping doing the housework - plus it will probably get annoying seeing how much the housework is piling up. But just take a deep breath and let him rant on... eventually I'm hoping he will get the message. And you have every right to some time on your own... say to him that from now on, every Friday evening you will be going out with your friends and he has to be home to take care of the kids.

I admit I'm not a mother (yet) but I hope I helped a little bit.

 

sage, i have played that game many times, i have refused to wash his clothes for weeks, made dinner for everyone except him! it doesnt work. obviously counseling hasnt worked, wel maybe for a week then he goes back to same old asshole!!!!!!!

a girl at work is look for a room mate but she has two kids of the same age....... it wold be total chaos non-stop so i think i am going to turn down the invite.... i am gonna look for my own place soon. after i talk to him and find out if theres any way we can make this work out...
