I also don't hate the Iranian people, the Venezuelan people, the North Korean people (Even though the North Korean people hate me, I believe those poor bastards have been brain washed.) or the normal people in the rest of the middle east. I luff Obama and his beliefs on freedom and democratic systems. Incarcerating suspected infinitely goes against the fundamental principles of the US Constitution. Why would any US citizen or the US president feel the need to exert authority above and beyond that is a crime to humanity and blasphemy of the people.
Obama is stepping all over the US constitution. What about state's rights, the states having the power to control most of the power and taxation without representation. Furthermore, I admit that the terrorists deserve basic human rights, thus they should be taken care of. I also agree (and I've said this before) that torture should only be used on people that you know have information, and not as punishment. And these suspected terrorists, if they are citizens of other countries, do not deserve constitutional rights.
Not a bad question, but I don't think constitutional rights apply to foreign citizens, even if they are in our prison. Why, "secure the blessings of liberty to ourselves" pretty much sounds like it is talking about us, Americans. Doesn't say anything about foreigners. Certain laws must still be followed even if you are not on US soil, like when you are on a US ship at sea, at an embassy, or in a prison. If one prison guard killed another, or stole property from the prison, he would be tried in US court. But the prisoners don't deserve the rights afforded to us by the constitution, because the constitution never mentioned them, and we are at war. I've said this before, but I do agree the tactics used need to be reformed. But not thrown out.
You are right, I didn't answer your question. I was explaining my opinion on the idea. No, that would not be OK. It would suck to be held captive like that, especially in Iran, a country where the government hates America. That is why I believe there should be a setup for trials. That is why I said that to you before, and I've said that to other people. You are right, this system IS NOT fair. Some of those guys could be completely innocent. So... that's why they are being set free. Because US authority over them is a crime outside of the US Constitutional law.
Thats easy, give them a fair trial. Since the government is charging these people are terrorists, then it is on the government to prove they broke the law. If the government can not prove they broke the law, then send them back to their home country, if the government can prove guilt, then punish them for their crimes. It not hard dude. We are suppose to be the good guys, we are either doing the right thing or we're not.
This one is easy too. McCain=Bush 4 more years of Bush=Bad, Bad, Bad Vote against McCain=Vote against 4 more years of Bush Whatever Obama does, there is a 100% chance it will better than whatever McCain had planned.
Does the justice system have any say over what a forign nantional does in some other country, far away?
The question was about gathering evidence. If I come over to your hosue and shoot you, there is going to be lots of evidence. The cops will rope of your house, search for fibers, footprints, tire tracks, blood spatter, etc. Then they are going to find the bullets, and be able to trace them back to my gun. All of this would be nearly impossible on a battlefield. I don't have an answer for you, there jaycola, but then neither does Obama.
US laws do not apply in far away places like Afganistan. I do not want to give our courts and judiciary system the power to preside over what people do in thier own nations. Trouble is Afganistan or anybody else did not declare war on Western nations. Individual citizens of diferent nations formed a cartel to wage war outside any national framework. These prisoners are neither domestic criminals nor representatives of a nation-at-war. They are not entitled to protections in the American Constitution nor protections assured uniformed armed servicemen under the Geneva Accords.
As I remember it the US declared war on Afghanistan after 09/11 and a bunch of Saudis hijacked some planes. The prisoners released from Gitmo that joined back up with terrorist organizations have mostly been Saudis.
