Are we incriminating ourselves by discussing our illegal drug use?

    i read an article in today's paper about a 14 year old girl in victoria BC who was drunk on alcohol and acting weird in a park. neighbours called the cops saying they suspected she was on E (which she wasn't) the police came and say she couldn't prove where she lived and didn't know her buzzer number so they took her into police custody. all on camera, she acted up and kicked her shoe off kicking it towards a guard. the guard then pressed her up against a wall until several guards grabbed her, bound her feet then tied her wrists behind her THEN tethering her by arms & feet to a doornob and left her lying on the floor like that for several hours. ALL ON TAPE. she's now 18 and suing.

    i have met a lot of people that did illegal things who have never smoked meth.

    until someone commits a crime, they shouldn't be accused of one.

    i understand that meth can be scary when taken by certain people...but that's the case with any drug.

    i personally have no interest in ever trying it--i'm a bit afraid of it....but i wouldn't judge someone who did or think them to be a certain type of person because they are on it.

    Means:

    You shouldn't talk about OTHER people's illegal actions.

    Illegally getting high on meth is a crime. So that would indeed make all users criminals. Is it right? That's a seperate question all together.

    it is not illegal to get high or be high!

    maybe you should do a little research.

    it is illegal to sell drugs but it is not illegal to use them.

    it is illegal to possess drugs but not illegal to be on them.

    funny, i thought everyone knew that.

    the only thing illegal about using drugs is that whatever you havent used yet is still in your possession so you can be charged.

    Be careful not to overlook conspiracy charges. When they can't actually catch you in the act, they'll gather a bunch of circumstantial evidence and convict you of conspiracy. I've had a few friends go down that way.

    For example, if I was to sit here and brag about selling large amounts of drugs, they would have more than enough to start an investigation. They are very good, and there are more of them than there are of you.

    So the recreational users don’t have much to be worried about. They of course have better things to do. However, serious dealers do have cause for concern.

    wow, did you like totally avoid the point.

    you said it was illegal to get high on meth. but you are so very wrong. now you go on to say something else without admitting that you were wrong. why should we believe what you say about this conspiracy stuff?

    are you sure you don't want to retract your statement about getting high on meth being illegal?

    i think conspiricy charges means the police may have or gain certain conspiricys about your actions and may even start an investigation if your posting about how you or a close friend have 1000s of hits of acid, meth, coke watever. i think salmons point was fairly straight foward, the police have bigger fish to fry then a couple of hippys and kids with a blotter here and there or 10 even, yet if someone is silly enough to come on here and post information about there cook or drug source they may find them self under investigation and if the police cannot find grounds to charge them with theyll get hit with "conspiracy to commit ......." or the old "disturbing the peace" anything they can find. ive been slapped with conspiracy charges on a few occasions when i was younger for growing a single pot plant which luckily was moved to my friends house a week before the cops came. they went through everything and found glass bulbs from smoking meth, chemicals from performing washes on meth (not that they were mine at all anyway) and other misc items. i was slapped with "conspiracy to commit the manufacture of methamphetamines and cannabis" but was released after my lawyer showed up and their lack off evidence came through. i still spent a weekend in jail for a few bongs a small pile of weed, hash and some glass bulbs. ended up with a court date and a big fine. to this day i dont keep more drugs then i can gulp down in one quick gulp or precursers to any chemical synthesis all together.

    meth is only illegal to some, you can buy methamphetamine in a nice little bottle and clear label in 5mg doses if you have the right prescription, yet for some reason to buy it in a baggie off someone on the street can put you and them in jail, strange world we live in.

    he was saying that they could use your words on a forum to charge you with conspiracy. i understand your situation - sorry to hear you had to go through that, but i still don't believe that they could charge you with conspiracy for just saying that you are selling or making stuff - i am pretty sure they would have to find good solid evidence like the materials to make it or the drugs in your possession. what someone says online may be used as reason to investigate but not reason to press charges.

    yeah im not to sure how the stuff online would hold up in court, first of all it could be anyone posting from your computer, people could be lying, all that kinda stuff. i dont think theyd have much of a leg to stand on with only that as evidence, yet if the evidence from a forum posting led to an investigation of some shady folks im sure theyd get enough to at least put them away for a while. all the best 3xi

    I have no idea what you wacky Canadians consider illegal or legal. And I don't really car. Here in the good old US of A, it's illegal to smoke meth.

    And the conspiracy laws are US laws. Again, you're on your own as far as Canada goes.

    As for admitting from your own computer, from your own IP, that you sell or manufacture drugs standing up in court...feel free to continue speculating. I've already done my speculating on this subject.

    Can you site a law for that, because I've read the U.S. federal Controlled Substance Act, and no where does it say anything about it being illegal to smoke meth. It is illegal to posses it (without a prescription) so a person could legally smoke it, if they had a prescription.

    They don't hand out smokable meth as medication in the US.

    to be of pharmaceutical grade a product has to be be 99% or more pure, smokable meth is just pure meth or smokable cutters if your unlucky, just cause its in tablets and you cant smoke it doesnt change the potency.

    My point was that there isn't a law against smoking it nor any other controlled substance.

    The legal term is 'possession' and 'improper use'. These substances are illegal to possess. Some are illegal to possess period, others are illegal possess with the intent for human consumption.

    I don't think it would be difficult to argue that you've possessed illegal chemicals if you're high on them since possessing them is a pre-requisite to ingesting them in some mannernot to mention all the uses I imagine you have in mind seem to be defined as improper.

    "It shall be unlawful for any person knowingly or intentionally to possess a controlled substance unless such substance was obtained directly, or pursuant to a valid prescription or order, from a practitioner, while acting in the course of his professional practice, or except as otherwise authorized by this subchapter or subchapter II of this chapter."
    Federal Controlled Substances Act. There are also tons of state laws (51 of them including Washington DC) so going into those is beyond the scope of this thread.

    I can think of several methods of getting high that don't require possesion, hot boxing, having some else shoot you up, someone holding and lighting a pipe for you, shotgunning smoke, etc

    maybe you should look that up. i won't ask you to show me the law because i no there is no law that says it is illegal to get high or be high.

    it is illegal to posses and to sell but that is as far as they go.

    Tyring to make the argument that smoking meth is legal in the US, is futile. It's also not all that relevant. If you want to start a new thread debating the legality of doing illegal drugs in the US, and what you could or could not be charged with, go for it. Again, as for what's legal in Canada I will bow to your wisdom. You know far better than I.

    As was mentioned early on in this thread, my opinion is that casual drug users have nothing to fear by talking about it here.

    maybe we should talk about your "wacky canadian" remark....

    if we are going to go on to what should or shouldn't be done in this thread.

    i am very much on topic. you are throwing out insults.
