Resolved: Harry Blackmun was always a conservative. Pro: -He was appointed by Richard Nixon, and was a registered Republican (at least when he was appointed). -He believed that true obscenity was not protected by the constitution. -He supported the death penalty, albeit in a limited fashion, MOST of his tenure on the Supreme Court. -He was always the one who said, he never changed, the court merely changed around him. Con: -He voted with the liberal bloc, on Roe v. Wade, and always supported a woman's right to choose, while on the court. -He eventually came out against the death penalty. (I don't have a cite yet. But I recall, he called it a "failed experiment", or something like that.) -Conservatives hated him. -Republicans hated him. -He was not "original intent" (the new litmus test of conservativism, at least now.) -When he resigned, he was arguably the most liberal voice on the court (but see above comment, too.) So I will leave it up to the rest of you to debate: Was Harry Blackmun a liberal, or a conservative (judge)? I thank you all who take the time to reply.
Definitely not a consertive, as a true conservative would only operate according to the Constitution.
