I also have anxiety while going to the toilet with people in the toilet too, I freeze up and can't go, so, I will wait until I'm really busting. and for some reason if I stick my fingers into my ears close my eyes and pretend no one is there, that's a neat trick that can work.
i suppose there is a bit of an honor system involved. if the employer really wanted to cheat the staff, they could, just like the staff could lie about their tips, or find any number of other ways to rip off the business if they really wanted to. there needs to be at least a minimal level of trust between management and staff, or else the staff should either be looking for alternative employment, or be fired, depending on who it is that's not being honest. i guess they could do a tip jar or something, and then stand there and watch while the staff counts the tips. when i worked in a restaurant the wait staff was just required to claim enough in tips to make up the difference between what they made and minimum wage, so they still weren't taxed on anything above that. and if they didn't make enough to cover that difference, nobody questioned them. generally management is aware if there's only 3 customers on a 4 hour shift, and they won't question if the staff claims to have made no tips during that time. if the place is packed during the entire shift, it would be hard to believe that they didn't get $4 an hour in tips.

What you say is correct in general. Even for states where the 'cash plus tip' minimum is less than the federal minimum wage, employees have the right to the higher benefit which is $7.25 per hour, assuming they are subject to federal minimum wage laws. This applies to all states. A situation where this would not apply would be if the employee was not subject to federal minimum wage laws. Examples might be full-time students and student-learners. Then the state law would determine the 'cash plus tip' minimum which might be less than the federal $7.25.
