If the Supreme Court rules that it won't allow states to disqualify presidential candidates from the ballot because of pragmatic consequences, the question remains about whether there is any sound legal basis for such a ruling in light of what is said in the 14th Amendment insurrection clause. Saying that the 14th Amendment clause doesn't apply to the office of the president would be a temporary cheap way out for the Supreme Court, but it doesn't settle the issue about how it could be used for various types of officials. Even Trump's attorneys during their arguments at the Supreme Court acknowledged that there isn't any explicit language that says it doesn't apply to the president. One of the Supreme Court justices mentioned a federal law that describes how to try someone for allegedly engaging in an insurrection, but the 14th Amendment doesn't say such a law needs to be used first.
