That's when I would get a note from the doctor talking about your chronic dry eye problems, or have your mom give you an alibi saying she bought them because your eyes had been dry and itchy later. Getting busted for paraphernalia when it's only eye drops is fucking bogus. Sucks ass dude, you definitely should only get a 250$ ticket though if it is decriminalized, and like you said as long as it gets dropped from your record it's all good
It's not really that ridiculous.... He was using it to hide the red eye so it's not like they were wrong about the reason he was using it lol.
That would be lying man. And not even a complete idiot would fall for that. You'd get yourself in more shit if you said it was for allergies. The cop would know your being a smart ass and treat you even worse. Once your caught, your caught.
But was he caught already?? it depends on the sitiuation. If I had nothing on me, and an officer wanted to know why i have visine, i wouldn't say cause i was smoking weed.
But it's not lying for most people. I know I legitimately use eye drops for allergies and dry eyes. But when have eye drops ever been classified as paraphernalia? Unless your state has specific laws that state that eye drops or rolling papers are considered paraphernalia you cannot possibly be charged for it and you can let your lawyer that you pay for rip the incompetent justice system a new asshole. There are two types of drug paraphernalia and they have STRICT GUIDELINES to follow so shit like this doesn't happen. User-specific products are marketed to drug users to assist them in taking or concealing illegal drugs. These products include certain pipes, smoking masks, bongs, cocaine freebase kits, marijuana grow kits, roach clips, and items such as hollowed out cosmetic cases or fake pagers used to conceal illegal drugs. Dealer-specific products are used by drug traffickers for preparing illegal drugs for distribution at the street level. Items such as scales, vials, and baggies fall into this category. Drug paraphernalia does not include any items traditionally used with tobacco, like pipes and rolling papers.
sounds like, you should be compensated or something, for that all being handled incorrectly. lol that will never happen though.
Your lucky you didn't get bounced from school. I think I have the record for shortest stay in a collage. At my first school (Franklin and Marshall) I lasted about 4hrs. I offered to smoke up my new roomate and he went straight to the RA. I was detained, but not arrested by campus police and the dean of students "suggested" that I take a semester off. My parents were still in town from droping me off. The car ride home with them was the longest of my life.
Oh and my two definitions of paraphernalia are direct quotes from the US Department of Justice website, so they're pretty legit lol
sucks purp, sucks bad but you are lucky about the school thing one of my good friends, i wasn't great friends with at the time, but we've grown mad close in the past month, anyway her first semester of our sophomore year she was busted in the car and was charged with 20 grams of purp (ironic?) and a scale with traces of mushrooms (that may have been what got her the most, along with all her bullshit friends blaming everything on her)---she lost the small scholarship she had, and was given the boot from our school (private)....she took a year off and now she is back at a state school...shit can be rough...i hope things work out easier on you than it did for her. good luck guys be smart, and even though that doesn't alaways work...be smart still good luck purp
i highly doubt bring up the fact that you were not read your rights will get you anywhere.. there is no proof that you were not read your rights except for you saying so..
Purp- People who are worth a damn generally get good character by making unfortunate decisions and being astute enough to learn from them. It's about all I have going for me. So life took aim and fired a shot- which will be deflected to some degree. I have a feeling that you're a quick study in the school of life though so you'll probably look back on this in 5 years and have a good chuckle... and be a better person for having dealt with it.
Most cops have dash cams that record audio. I don't know if those cops did, but I'd find out if I was you...
well there were two people watching me get arrested and many other people around. that doesnt matter i have found. i wasnt being questioned when i was also being detained so they didnt have to read miranda apparently...i SHOULDN'T have been taken to jail though. i had less than 35 grams and in columbia, all that they are SUPPOSED to do is take the substance and issue a court date. decriminalized my ass... one thing did strike me super strange - they didn't tell me all what i was being charged with until after i had been sitting in the cell/paddywagon for a good hour. one cop had said that i'd probably be only charged with the 500 for the pot (papers not being para) but after i got to being booked i was charged with the extra 500 (thus 50 more dollars on my bail bond) im already laughing at it...it was a stupid stupid stuuuupppiiiiddd mistake to have gone through the checkpoint, even though a friend went before us and said there were no K9 units. my sister said my dad has been calling her a lot lately asking if i am in trouble yet or if i am all good...lol so maybe he is already expecting it. hopefully he wont be too surprised to find out.
my friend that got arrested with me has three lawyers in the family and i have one. im covered on the lawyer bit and there is no way that i should lose any school funding at all or have anything related to school be put on me, since it is decriminalized absolutely. we could have been drinking, we could have already smoked (DUI for my friend), we could have had alcohol on us. my other friend in the car could have been sent to jail (he's on probation) if anything had happened to fall on his ownership
