under the Judiciary Act of 1789, the Court was to be composed of six members, Roosevelt proposed the Judicial Reorganization Act, and wanted 15 justices, but thankfully the 'court packing' attempt was rejected.
Fortunately, the Founding Fathers did not enshrine the number six in the Constitution. The Judiciary Act of 1789 was an ordinary piece of legislation, and could be altered at will by Congress. And it was, more than once. The number has ranged from five to ten. There is nothing at all sacred about the number nine, and there is no indication whatsoever that the Framers wanted to curtail that important check on an abusive judiciary. So what's your point?
Seems to me all the court said was that no one can be removed from a state ballot when running for a federal office if they participated in an insurgency. They said nothing about Section 3 of the 14th. So if Trump were to be elected, he could not serve as President unless two-thirds of each House agree that either January 6 was not an insurrection, Trump had no part in that insurrection, or he did participate in an insurrection but he can serve anyway. The Supreme Court would have no say as to whether he could serve or not. It would be up to two-thirds of each House and I don't see how that would happen, but Trump and his allies would insist that he be placed in office.....which they are going to do anyway even if he loses. Trump will declare himself the winner in the up coming election no matter what happens then it will be up to the Republican party et al to either stand up for law and order or sell their county down the sewer. They may resort to another violent attempt to place Trump in office. In that case don't be surprised if Biden calls out the military to restore the Republic....as he will clearly be immune from any act, criminal or otherwise, that he commits during his presidency as the Republicans themselves maintain.

The insurrection Act was made law on March 3, 1807 and signed by Thomas Jefferson. It was originally intended to allow the capture of Aaron Burr when he plotted to raise an army, invade Mexico, and claim it for himself. It allows the President to determine when an insurrection has occurred, or is in the process of occurring, and to deploy troops to suppress, among other things, any conspiracy that “so hinders the execution of the laws”; as in an attempt to stop the peaceful transfer of power. No trial is needed to invoke the act although the courts may review to actions taken by the troops after the act has been invoked. No trial is needed to first prove a conspiracy. It has been invoked by Washington, Adams, Lincoln, Grant, Jackson, Hayes, Cleveland, Eisenhower, Kennedy, and Johnson. Were Trump to again attempt to interfere with the election or deny the results and call upon a mob to storm the Capitol, Biden would be fully capable, and within the law, to have him and all his co-conspirators arrested. Trump should have invoked it on Jan. 6 to stop the invasion of the Capitol building...but as the sent the rioters he wouldn't have wanted to do that.
