    So if the dems win the presidency, are the repubs going to tie up a nomination? Four years? Eight years? What a bunch of bullshit.

    The court is now extremely biased politically and the media seems to be accepting this state of affairs. I suppose the court was always divided into liberals and conservatives, but the
    standard belief has been the justices should leave their biases outside the court and rule on the issues put before them as they pertain to the constitution Now it's just right out in public that one side will win and one side will lose with a confirmation on either side. It is being discussed in just those terms.

    So IMO, due to the contentious atmosphere the right has caused over the years, the supreme court has "come out of the closet," so to speak and hence will remain highly politicized from here on out.

    Nobody seems to be able to find in the Constitution any penalty for behaving that way, so watch out. Mitch McConnell may soon state that he will never, ever "advise and consent" for the President to appoint a justice that is not a conservative Republican. Or he may just let us figure it out for ourselves.

    This could become a true constitutional crisis.

    How about forcefully pushing NDAA into law? You know, the Patriot Act on STEROIDS!!! The martial law bill that gives the government the power to arrest and detain anybody indefinitely due to "terrorist"suspicions. Or how about granting the NSA to collect and store the phone records of every American and foreigner making phone calls within this country? Where was the protection for such whistleblowers he promised? How about expanding the DHS into deeper tyranny in our nation's airports with nude body scanners, and giving government security agents the authority to grope and molest travelers and children of travelers?! Haven't you heard? Oh yeah, Obama would make a great supreme court justice....

    I don't know about the rest of you, but I'm sick of leftwing and rightwing activist judges making their way to the supreme court. Lets appoint strict constitutionalists for a change.

    Well... That and he doesn't have the education for it either. The point is though, anyone claiming to be a "strict constitutionalist" these days has an extreme right wing/libertarian bias going on, so Yeah... That would work really well.

    Yup. I'm not sure at what point overt political bias entered the Supreme Court but it kinda negates the whole purpose of it.

    But the Republicans are always talking about the enforcement of the "original" constitution. Ted Cruz says that all the time. Republicans want state rights and business rights that in the past have resulted in laws for the return of escaped slaves, because Negros were considered property of business owners, and that was what they wanted under the "original intent" of the constitution. That crowd never did like the thirteenth, fourteenth, and sixteenth amendments. They only like the second and tenth. So, they have a serious dislike as to the present state of the constitution and wish to change it.

    Yes, the court has always been divided between progressives, and regressives, but it became more pronounced in Bush vs Gore, and even more so when Obama became president.

    This whole phenomenom of getting 'appointed for life' by a biased temporarily majority in court seems kind of medieval to me. Does anyone else here think that this thing on itself is kind of dubious?
