    Not only has randy andy lost the latest court room battle, but the court has also ordered the disclosure and publication of a settlement agreement between himself, Epstein and the victim, Virginia Giuffre.




    Prince Andrew cannot halt sex assault lawsuit with domicile claim, judge says

    1 January 2022, 0:21 pm(AP) - The Duke of York’s effort to immediately block the progression of a lawsuit by a woman who says he sexually assaulted her when she was 17 — on the grounds that she no longer lives in the US — has been rejected by a federal judge.

    Judge Lewis A Kaplan, in a written order Friday, told the prince’s lawyers they must turn over documents on the schedule that has been set in the lawsuit brought in August by Virginia Giuffre.

    Ms Giuffre says she was abused by the prince on multiple occasions in 2001 while she was being sexually assaulted by financier Jeffrey Epstein.

    Andrew has denied all the allegations.

    The prince’s attorney, Andrew Brettler, has called the lawsuit “baseless”.

    The order was filed three days before the scheduled public release of a 2009 settlement agreement between Epstein and Ms Giuffre.

    Lawyers for Andrew say that the agreement protects the prince from claims like those brought by Ms Giuffre and will be sufficient grounds for the lawsuit’s dismissal.

    The prince’s lawyers had claimed the evidence was so strong that Ms Giuffre does not reside in the United States that it was pointless to exchange evidence until that question is resolved because it could result in the lawsuit’s dismissal.

    They argued that Ms Giuffre has lived in Australia all but two of the past 19 years, has an Australian driver’s licence and lives in a home in Perth, Western Australia, where she has been raising three children with her husband, who is Australian.

    In a statement, Giuffre attorney Sigrid McCawley called the request to halt the case “just another in a series of tired attempts by Prince Andrew to duck and dodge the legal merits of the case Virginia Giuffre has brought against him. All parties in litigation are subject to discovery and Prince Andrew is no exception”.

    Judge Kaplan, in a one-page order, noted the prince’s lawyers have requested that “extensive” materials be turned over by Ms Giuffre by January 14, including documents related to where she has lived.

    And he said the prince’s attorneys have not yet formally raised the defence that the lawsuit cannot proceed on the grounds that Ms Giuffre has been living in Australia rather than Colorado, where her lawyers say she is a resident.

    His order expressed no opinion on the merits of the prince’s claims that Ms Giuffre should be disqualified from suing because she lives in Australia.

    Oral arguments via a video teleconference on the prince’s request to dismiss the case are scheduled for Monday morning.

    In October, the prince’s lawyers attacked the lawsuit on multiple grounds, saying Ms Giuffre had made false claims against Andrew because he “never sexually abused or assaulted” her.

    “Giuffre has initiated this baseless lawsuit against Prince Andrew to achieve another payday at his expense and at the expense of those closest to him. Epstein’s abuse of Giuffre does not justify her public campaign against Prince Andrew,” the written arguments said.

    Epstein killed himself in a Manhattan federal jail in August 2019 as he awaited trial on sex trafficking charges.

    His former girlfriend, Ghislaine Maxwell, 60, was convicted on Wednesday of charges including sex trafficking and conspiracy after a month-long trial.

    Under English law, you cannot sign away your legal rights, so over here such document would be held: Null and void.

    American law is substantially based on English Law, therefore it is a moot point as to whether the New York judge follows previous case precedent and throws out this document as being irrelevant.

    Andrew’s accuser to have day in court as judge rules civil sex case will proceed

    12 January 2022, 2:30 pmThe Duke of York will be tried over allegations he sexually assaulted Virginia Giuffre when she was underage after a US judge ruled her civil lawsuit can proceed.

    Judge Lewis A Kaplan’s decision is a huge blow for Andrew, whose lawyer argued earlier this month the case should be thrown out as Ms Giuffre had waived her right to pursue the duke by signing a confidential settlement with disgraced financier Jeffrey Epstein.

    In the conclusion of his written ruling, Judge Kaplan said: “For the foregoing reasons, defendant’s motion to dismiss the complaint or for a more definite statement is denied in all respects.

    “Given the court’s limited task of ruling on this motion, nothing in this opinion or previously in these proceedings properly may be construed as indicating a view with respect to the truth of the charges or countercharges or as to the intention of the parties in entering into the 2009 Agreement.”
    This year is a period of celebration for the royal family as it marks the Queen’s Platinum Jubilee, but the monarch and senior royals face the prospect of the duke’s accuser giving a detailed account of her allegations in open court this autumn.

    The institution of the monarchy is likely to be damaged by Ms Giuffre’s civil sex case, which will be heard in New York and is expected to make headlines across the globe.

    Andrew’s reputation has already been irreparably tarnished by his friendship with Epstein, a convicted sex offender, and he withdrew from public duties soon after his disastrous 2019 Newsnight interview that failed to draw a line under his relationship with the disgraced financier.

    Ms Giuffre is suing the Queen’s son for allegedly sexually assaulting her when she was a teenager.

    She is seeking unspecified damages, but there is speculation the sum could be in the millions of dollars.

    Ms Giuffre claims she was trafficked by Epstein to have sex with Andrew when she was aged 17 and a minor under US law.
    The duke has vehemently denied the allegations and his legal team has argued from the lawsuit’s first hearing that the case is “baseless”.

    There has already been speculation the duke may be encouraged to reach an agreement with his accuser in a bid to avoid the trial being held.

    If the hearing does go ahead it is not clear whether Andrew will give evidence in person, via a video link or decline to participate.

    The settlement between Ms Giuffre and Epstein, made public earlier this month, detailed how Andrew’s accuser had received a 500,000 US dollar (£370,000) payout in 2009 and agreed to “release, acquit, satisfy, and forever discharge” the disgraced financier and “any other person or entity who could have been included as a potential defendant”.

    Andrew B Brettler, the duke’s lawyer, had argued during a virtual hearing his client was a “potential defendant” as defined by the agreement and so the case “should be dismissed”.

    The lawyer said a potential defendant would be someone Ms Giuffre knew she had “claims against at the time that she filed the lawsuit” in 2009 against Epstein, whose former girlfriend Ghislaine Maxwell was convicted on December 29 of procuring teenage girls for him.

    In his counter-argument David Boies, Ms Giuffre’s lawyer, said only the parties of the settlement agreement – Epstein and Ms Giuffre and their associates – could benefit from it, and not a “third party” such as Andrew.

    He added the duke would not be a “potential defendant” as referred to in the settlement, as the 2009 lawsuit made no allegation the duke had trafficked individuals for illegal sexual activity.

    The lawyer told the hearing, held to hear arguments about dismissing the case: “He was somebody to whom the girls were trafficked – that’s a different criteria.”

    I'm relieved about that ,although it it a civil case .

    I dare say should the civil case stick then criminal proceedings may take place after .

    Nobody is above the law . The British PM will find that out shortly.:cool:
