I have stated several times, it needs to be case by case basis. I've explained my theory before. Case by case basis considering ALL circumstances not just blanket age laws. Really? According to whom? I guess since my wife was 17 when we were married, I failed. She would disagree with you and so would most people who know me. It's ALL situational ethics. It's all relative to the circumstances in every single case. Either you are mature enough to consent or you're not. If so, no crime. If not, rape or molestation. Blanket laws, in all cases, cause more harm than benefit.
So you would prefer to leave the law in the hands of individual judges? Our legal system is entirely based on precedents. Personal politics would always come into play if each judge was able to determine what is right or wrong. One tells you that it's fine that you married a 17 year old, the next wants to put you on the sex offender registry. Judges could show favoritism to friends of friends, punish out of spite, etc. I'd rather know that I'm going to get a $200 fine and 6 months of probation for a sack of weed rather than leave it entirely up to a judge who could theoretically send me away for 2 years because he takes a firm anti-drug stance. For as much as you complain about many aspects of American gov't, the solution you provide is no better than what we currently have.
I didn't say no laws, spastic. I said "blanket laws". Sure, we need to have a standard. Such as, murder. If you murder someone in cold blood and are found GUILTY, all circumstances need to be taken into consideration (of course) and then you should be handed your sentence. However, when we are dealing with matters of maturity, your boys want to use my method when it comes to the minor killing someone, but use their blanket law when it comes to "statutory rape" (for instance). If they do this when the minor is the criminal, why not take it into consideration when they are the "victim"? People are different. Circumstances are different. Judicial discretion should be able to be used in such cases. And yes, I am afraid it is much better than our current system. Under your blanket government the circumstances of the case can only determine "guilty" or "innocent" without degree, and this sets up mandatory minimums. The Judge cannot take into consideration the circumstances when deciding sentencing. I suggest you read the ACLU website's Criminal Justice page on Sentencing and see how your blanket laws and mandatory minimums work. Most states have classifications and degrees of criminal behavior based on the age of the victim and the age difference between the victim and the "perpetrator." I suggest any man who dislikes these laws moving to Hawaii or Pennsylvania the law says 14 is the age of consent in those two states (or four years difference) I have seen a lot of injustice...a couple of examples.... when I was 8 a father of one of my friends asked my parents if me & my sister could stay the night with his daughter...well alarm bells rang in my fathers ears so he said no...a week later we found out that he had gotten two other little girls to come stay and he molested/raped them both but he only served 2 years second one being my brothers' own incarceration for statutory rape...he served 5 years for it...he was 19 and the girl was 17...they were actually dating but when he had a disagreement with her mother...the mother got upset and called the cops....it wasn't rape and in my opinion this 17 year old girl was old enough to consent but that is the law in South Dakota Even tho I hate the prison system and I do not agree with many of the laws we have ...laws are necessary and this law is purposeful one just my opinion.... blahh
