My Response To A Recent Meme.

    (recent far rightwing meme on transgendered and transvestite women).


    Okay, "left alone" you say? Well, you can criticize them in every modern democracy. But hate speech differs from jurisdiction to jurisdiction. Under the 1942 Fighting Words Doctrine (Chaplinsky v. New Hampshire) which was unanimous BTW, which is rare, any words that are insulting enough because they are meant to inflict injury, supposedly because tend to incite an immediate breach of the peace. Now, in Europe, Canada and South America, any hate speech is not protected. In fact holocaust denial is usually illegal.

    On the other hand, obscene speech is never protected, except maybe still at home [Thomas agrees BTW]. But pornographic material (which is just material that shows sexual nudity or sex in a sexual way, though it is probably still protected) is different. And newer rulings are changing. You must never read a Hustler magazine on an airplane, they say in Georgia, because people might see the dirty pictures. Even though it is political satire, and obviously protected (read Miller). So, the very conservative and Republican, Alan Dershowitz says, stop reading over my shoulder, lady! You're behind me, and I saw what you did! My seat isn't even reclined yet.

    Anyways, if they don't like Hustler in Georgia, they can move to Russia. Hate speech in my opinion is the true obscene speech. Maybe we should rethink that in this country now.
