Thank you for your post.

Trying to not spend a day and a half writing a book on this, I shall try and cut to the chase in respect of the main happenings surrounding this situation.
Not long after we moved in here 5 years ago I had cause to ask him to stop parking in our car parking space.
He thought he could because we don't run a car, but of course we do have people visiting us.
This started him off on a Troll Neighbor From Hell course of action!

Just to try and explain just one incident with this person, who was a Director of our building Management company who among other things deal with possible breaches of the lease.
So being in breach of the lease can be a very serious thing, and can even possibly mean us having to give up the lease and move out of our home.
This even though we have purchased it outright and have no mortgage on it.

This man Colin Elston complained about seating we had in the garden, about pots on our wall, about shrubs we had put in, about our outside CCTV camera and about the height of our hedge just to mention a little few of the complaints he made.
He constantly over a period of 4 years and still is he just kept taking photographs so as to make issues with the management committee and complain about us and our home.

To try and put a very long story short, three years ago we had to cut down our hedge you see now to a much lower height than now, with the front bit almost down to the wall.

Last year I had an independent risk assessment done which came back that came back that the hedge could be a normal height all the way along.
So last spring I started to let the hedge grow back to it's normal height as it is now.
The Man didn't know about that risk assessment, but he noticed that the hedge was growing higher, which kicked him off again, hens all of his fresh picture taking.

Again after my challenge he backed off following a solicitors letter to him that the hedge was lawful and that he must desist in harassing me, and the Management committee came down on my side with a vote.

So for the past year he has left me alone and kept a low profile out of embarrassment because other residents saw the videos.
Plus he resigned as Director, put his property up for sale and was humiliated.
So I put him back in his box.
Or so I thought!

Better than an episode from Neighbors From Hell I reckon that is!

Just little part of he risk assessment is below, and that got him madder than a bull being waved a red flag!


Risk Assessment:

Dear Mr. Thain.
'To refresh your memory you asked me to look at the hedge to see if was ok for you to increase the hedge height (which is shown on the left side of the photograph) to the same level of the hedge height on the right hand side of the photograph.
I mention that the previous directors had requested you to cut back part of the hedge to assist owners a line of sight when egressing the car parking area.
A Director had completed his own risk assessment and you had complied with his request.
At a later date the Director had arranged for a mirror to be placed at the site entrance which improved the line of sight.
It was my view, as the mirror was more effective.
Cutting back a portion of the hedge to provide a line of sight was no longer necessary.
We discussed this and both Karen and I remember you mentioning that as there is a Mirror at the site entrance there was no longer a requirement for the owner to cut back his hedge which is located on the left hand side of your photo.'

Around 5 years Mystic, so it is no wonder I get rather angry about this.
Let anyone else try and live by a neighbor who is constantly looking into your garden and property and taking pictures and complaining to the Management Commmittee and see how they like it.

I understand this all to well in my early 20s i roommate in a house with 3 military guys and girlfriends our house was party central we had a older lady next door who called the cops and fire department on us so many times that the fire marshal finally told her that emergency services would no longer respond to her calls as she had cried wolf to many times.

 

I think I am drunk. lol

 

Ah well I thought you had abandoned the site. Glad it is not so. I have been ok, other than spring allergies, a lovely dripping nose and what not. You are a good egg nebulous. The sight of your warm glow warms my heart.

I sent my neighbour from hell the below E. Mail earlier, and posted it in his letterbox as well!.......

12th June 2020

Dear Person *****
I am aware that even after 5 years of you interfering in the quiet enjoyment of our property, you are still showing an unnatural interest in trying to spy and monitor and look into our garden and property through whatever hedge or other openings you can find.
On past experience I have no doubt this is in order to see if there is anything else you can report to ******** Management.
With my past experiences to hand, this in order to try and cause my Wife and I further distress and trouble.

I note that not once in 5 years have you made any attempt to talk to me about any issues you feel are troubling you.
Instead you have chosen to hide behind your ********** Management Director coat tails smoke screen.
Then you hand your 'bullets' to *******************************for them to fire your vindictive and trouble causing 'bullets' at my Wife and I.

This includes you taking all of your photographs last year (which I have on CCTV) so you can send them to ******and whoever.
This in order to report that we have had the audacity to grow our hedge to a height which hinders your ability to pry and spy on our garden and property.

When I tried to talk to you in the hallway very reasonably and in a quiet voice about the Sky Q and Hedge issue some 2 years ago, all you could say was:

'Come on ***, we will talk to this Little Man through our solicitor'.
This was yet another all mouth and no trousers threat you made to me.

At that time instead of being willing to talk to me Person to Man, you scuttled off to the Police and complained to them instead.
Not that they supported you at all in any way!

My observation is that this typically cowardly way of yours of going on does you no credit at all.

Please allow me to do just a little summing up in respect of your 5 year campaign of harassment towards my Wife and I:

You lost in trying to stop us having our Sky Q installed that day I refer to.
You lost in your efforts to have our hedge cut right down to just the top of the wall.

The recent subsequent health and safety inspection in respect of our hedge has shown that your spurious and vindictive reasons for trying to force that on us was not justified.
It was based on the absolute lie that the height of our hedge was a safety matter in respect of cars leaving our car park.

You lost in your efforts to have our CCTV security cameras taken down.
You lost in trying to have our pots taken off the wall.
You lost in trying to stop me supplying apartment residents with The weekly Pioneer Newspaper, citing the Fire regulations to justify that action.
This of course led to having to remove your hypocritical storage unit from outside your door on the landing to make YOU respect of the Fire Regulations.
Shooting yourself in your foot springs to mind!

This all makes you a Loser to the extent that you have no authority in this building now, which is good.
Which is good, because when you do have some authority, in my experience you only abuse it.
And of course.
The bigger they are.
The harder they fall.
And God Man.
Have you fallen.
When I first moved in here you were Mr. Big shot firing bullets.
Now you are Mr. Little Shot firing piss which is splashing back on you!

It is finally time that you stop trying to continually monitor and spy on our property and garden.
As previously mentioned by me, whenever I have tried to talk to you about anything in order to try and reach a reasonable conclusion to whatever is bothering you.
You refuse to engage and talk to me.

Please note though Person ****** that should you continue with your actions, then I am going to have to confront you either in our hallway, or path leading to our apartments.
This in order so as to talk to you reasonably about this if you are willing.
Person to Man.
Please yourself.

All this is now so simple.
You leave me alone, and I leave you alone.

Finally.
I wish to offer you some friendly advice.
I see you have your property for sale.
You should keep in mind that for 5 years one way and another you and I have been in a neighbour dispute.
Until if and when this is all totally settled amicably, then as far as I am concerned I am still in neighbour dispute with you.
I trust that in the event you manage to sell before this dispute is finally settled, then you will declare this on your seller information forms.

because 3 of the people in the house and most of the guest were military we were very careful not to break any laws as the penalty for active duty people is very bad
