This should have been the first thing he did. If he had he would have never been put in the spot of admiting a crime on tape. You get pulled over and whatever drug is found. You do not know anything just say you would like a lawyer if you are being charged with a crime. Until you speak with that lawyer you will exercise your right to remain silent so as not incriminate yourself. There is a reason cops tells you "everything you say will be used against you". What the cops did in this situation was make their job of making serious drug charges stick easier. If they can do this they get more money. Money that comes with no strings attached and no one watching it. Who do you call when the police rob the public? There are numerous examples of expensive but unneeded personal things have been bought on the city dollar from cops. They saw him for what he was, a nervous kid and made him more nervous. He probably did not think of or maybe even know he doesn't have to do anything. Of course the cops will say if you talk to us it easier. Remember they are not your friend. They are trained in various tactics to psychologically fuck with you. Filming you is legal as long as you don't say it is not. They can not charge you with another crime for not agreeing to be filmed. Had he talked to a lawyer the cops would not have made it easy on him. Throw him in the back of the car cuffed and probably try to be less of a friend and more intimidatory. He would sit in a cell for a bit but in the end he would have less charges. The lawyer is not going to allow him anywhere near a camera where he is talking about the crime either.
How insidiously, maliciously ignorant and small-minded. Fuck you and your disingenuous appeal to authority and victim-blaming.
Exactly. They knew he was from out of state and 800 miles or more from home. Cops expect you to tell them the truth, but they're allowed to lie and deceive during interrogations. To make it seem like you'll be in even more trouble if you take advantage of your constitutional right to have an attorney present during questioning. "It's ok, there's no need for lawyers at this point. We know all you want to do is get out of here and go home. So just make a statement and we can wrap this up and send you a summons. If you insist on a lawyer, you can have one but we'll have to take you in. Then there's the issue of bond, and you won't see the judge until Wednesday. Also, this will make it seem to the State's Attorney like you didn't cooperate. Like you had a bad attitude." That's the time to insist on a lawyer. They may indeed take you in, but in the long run you're better off.
first time you definitely get probation. I was busted with 20 dime bags of heroin my first time and got an I-Bond and then plead to probation you have nothing to worry about you will be home in no time. Don't fuck that probation up though!!!!!!
yep this is the guy from the post right above this one. You should not have said shit police are not your friends they will lie to you 100% of the time so that bullshit of the officer saying just tell me what it is and i'll ley you go. Shit man he's tryin' to make his case against you a piece of cake man. you shouldn't have said shit!!!!!!!!!!!!!!!!!
i told a cop once that i was on g after being pulled out of a vehicle unconsious on the side of the road (told him while half annihalated, didnt know what i was doing). i was charged with impaired driving on the spot yet it was dropped half hour later when the effects wore off and i told him he was crazy and he couldnt prove there was anything in my system. pretty crazy, moral of the story = dont drive while fucked up lol. they can charge u with anything but difficult to make things stick
Dont get a public defender get a reputable lawyer and you could possible get off easy. Ive had something similar happen but since it was a charge so far from where i live I paid a fine and that was it,
