I was just wondering, with the new make up of the SCOTUS. Will porn ever be banned in the United States? Just to be clear, Roth in 1957 supposedly started the trend of loosening the restrictions on porn in the US. They never officially legalized it. Then in 1969, with Stanley v. Georgia, 394 U.S. 557, the US Supreme Court recognized for the first time that the government couldn't outlaw mere possession of obscene material. The case itself is interesting, because when the Georgia police searched the residence of Robert Eli Stanley, they weren't even looking for obscene material, but bookmaking apparatus. I'm not exactly clear on what the Originalists' on the Supreme Court's view of pornography and obscenity is. Plus they follow a process called super precedents that basically all the so-called "liberals" like Ruth Bader Ginsburg have been following for many years anyways. The make up the court is unusual now. Along with the four "liberals", there's Chief Justice Roberts, who believed that Roe v. Wade should be upheld, not because he's pro-choice (his pro-life credentials are impeccable—anyone remember his contentious nomination process under George W. Bush?). Gorsuch can surprise you sometimes, though not always in a good way. He supports limited gay rights, like Roberts, but voted with the conservatives, but voted against Roe. And then there is Thomas, who is very "pro-First Amendment" (fill in your own jokes). So will the Supreme Court ever bring back the draconian restrictions on porn and obscenity? And when may this happen?
Unlikely - unless we get a strong majority of females on the bench (like 7 of 9) And, unfortunately, that is a possibility. If we get a majority of elected politicians being female - and we're getting closer every day - the senate could become female-centric and then heaven only knows what may befall.
