I think it would depend on your state laws, as mentioned before, i think the only charges u could get would be public intox and "internal possesion" which ive never heard of before now.

No you can't get in legal trouble.
Remember the Nagano Winter Olympics when the Canadian Snowboarder, Ross Rebagliati won the gold medal but tested positive for marijuana. He said he never smoked it but was with people who were and must have gotten a small amount of THC second hand. Drug tests test for THC, they don't say the amount so a person could always use that arguement

 

This is out dated. New test are more sensitive. In any case, it is quite possible to measure the quanity of THC in a blood sample.

u could get in trouble for it because people could get u intoxicated befor a drugs test say spike ur drink for some reason so i cant see why they could use that as a way to get u out of a school or watever

 

I was always under the impression that you could only get in trouble with the law if you were in possession. I'm pretty sure even if you failed a drug test you still can't be arrested or anything (only fired from a job, for example) because really now, what if you were just around someone that was smoking? You can test positive for it just by second hand smoke so you're supposed to be arrested for that? That'd suck pretty badly. But I'm not 100% certain about this...I just always figured that's how it worked.
