California is the first state to ban 'stealthing,' nonconsensual condom removal ... I must have missed that episode of FRESH AIR or MORNING EDITION. This is new(s) to me!
Frankly, after reading the article, I would have made it an actual misdemeanor. As I understand it, the term 'assault' is the threat of physical violence. 'battery' is actually touching someone in that manner. This seems to come awfully close to 'battery'. Yes, it may not be an argument in a bar, but it involves two people, one of which does not wish to be touched in that manner. Seems pretty close.
I'd go even further, what an 'asshole' thing to do! Needs to be taken outside and "explained to' (punched) by decent males.
