    Never let the cops see or smell anything that can warrant a search. If a cop comes to your door and sees even a roachclip, then it will give him/her the right to search your whole house.

    1. your safest in your home. store it and smoke out of plain sight in your home.

    2. your least safe in car or while committing some other crime. don't smoke and drive. minimize the amount of time your carrying. don't smoke while tresspassing or tresspass while you do it (i'm a big fan of getting lit in the woods, so thats tough for me).

    3. know your rights - and always exercize your right not to be searched even when you have nothing to hide. get confortable saying 'i do not consent to a search of my (person/vehicle/bag/home)" do not physically resist.

    this is from the 4th ammendment....

    if a cop ever asks, "mind if i take a look in your car", just polietly say no. if he asks why, just say " well, i have a 4th ammendment, i might as well use it".

    that's what i told my kid and thats what he told the cop and the cop let him go. learn your constitutional rights.


    now sorry, this is going to be long but it may just save your ass! copy and paste it somewhere and review it every now and then:

    This rap sheet is a tool. Read and understand it and next time YOU will have the upper hand in the situation.

    ROADBLOCKS (DUI CHECKPOINTS, ETC.)

    ALWAYS assume you will run into a roadblock on the way in. It is very important that you know your rights before reaching the roadblock because this is where most of the coercive tactics and encroachments of rights will take place.

    Law enforcement officers are trained to intimidate people into consenting to searches. You may be asked SEVERAL times during the detention if they can search your car or person. ALWAYS refuse and you¹ll be fine. The only legal reason they have to search you without arrest is that they feel they are in danger of being attacked which should not be an issue with rainbows.

    If you do find yourself under arrest for any reason, always exercise your right to silence. Continue to refuse to allow any searches and politely inform them that you will not say anything until your attorney is present.

    Your driver's license, registration and proof of insurance should be legal and accessible. You will sometimes need all three as the requirement laws vary from state to state. Always assume that you need all three and you'll never have a problem.

    Your car must be road-legal. No broken tail-lights, windshields,headlights, etc. You will be cited for these.

    Never leave anything in "plain view." Anything inside the car that is visible to the officer is considered to be in "plain view." Although this does not give them the right to search your car, they can confiscate the item and place you under arrest. They will still need to obtain a warrant to search the rest of your car which will not be very hard if they found something in plain view.

    Never consent to a search of your body or your vehicle. This is your fourth amendment. The only reason they would ask is that they do not have enough evidence to obtain a search warrant (or they may just be too lazy to get one). JUST SAY NO!!

    At rainbow gatherings in the past, officers have been known to plant drugs in cars after consent to search is given. You can avoid this problem by refusing to consent.

    If you are harassed or mistreated, write down all the information you can about the incident. The officer's county, name, rank, badge number, etc. Date, time of day, location, etc. Contact one of the organizations listed at the end of this document to pursue the matter or just file a complaint with that officer's superior.

    OTHER POLICE CONTACT

    It is important to remember a few things about police officers. One is that they are aware of your rights and they have been known to intentionally violate them. If you find yourself in a situation with an officer who is out of control, it is best to be submissive in order to avoid injury or even death. Remember that THEY are ARMED AND DANGEROUS!

    If you are stopped by an officer outside of a vehicle, your contact with him/her will fall into three categories. Consensual contact, detention or arrest. We are mainly concerned with consensual contact and detention as this document is intended to help you in NOT GETTING ARRESTED.

    CONSENSUAL CONTACT

    Consensual contact means the officer comes up to you and says, Can I speak with you?" If you say "yes," you have consented to have contact with the police. This is not good. When you consent to contact, you waive some of your rights especially if you think you may be guilty of something. NEVER consent to speak with an officer.

    If the officer asks, "can I talk to you," reply with something like "I'm sorry, I'm in a hurry and don't have time to talk to you right now." If he/she insists, ask, "Are you detaining me? Am I free to leave?" You should ask this several times to make sure the officer will remember you asking if the encounter results in an arrest and court case. If it is really a consensual contact, the officer is required to let you go on your way if you ask to. If you don't verbally ask to leave, the court will presume you consented to whatever follows.

    DETENTION

    The police are only allowed to detain citizens when there are "specific and articulable facts supporting suspicion" (SAF) that you are involved in criminal activity.

    This means they can't detain you on a "hunch." They must have observed something about your behavior or character that links you with specific criminal activity. If you are detained without SAF, you are detained illegally. If this matter ever lands in court, you may be able to get off because the original detention on their part was illegal.

    When you use terms like "detention" and "specific and articulable facts², the officer will usually back down a bit. The majority of a police officer¹s power in the united states comes from intimidation and prey on the public¹s ignorance of its own rights.

    It is crucial that you let the officer know that you are not consenting to talk with him and that the only way you will talk to him is if he detains you which he can not do without SAF.

    ARREST

    If you find yourself under arrest, there's not much left you can do. You are going to be searched. It is important to continue refusing consent to search your vehicle (if there is one involved) as they will still need a search warrant to search your vehicle. This, however, will not be difficult to obtain now that you are under arrest.

    By refusing to consent to a search of your vehicle, though, you are maintaining your position. They may get impatient and search the vehicle without a warrant which is completely illegal. If this happens, anything they find in the vehicle will not be accepted by the court because it was evidence obtained illegally.

    Those are the basics rights you have when involved with the police. By exercising these rights and using a little common sense, you should be able to have a safe and happy gathering. Below are some legal contacts you may find yourself in need of if placed under arrest.

    I know that I sure as hell didn't consent to a search. But a piggy's little fine-tuned nose and sixth sense that said I was high gave him enough probable cause. Then finding only a one-hitter gave him probable cause to take my piss and charge me with a DUID....now ain't that some shit?

    dont go walking down the street with it (espeacially high) dont smoke anywhere in the open...try to stay on your property or on a friends property where u cant really be seen by anyone...basically always stay hidden...

One is a Desenex can that I keep in my toiletries bag (no, I don't have foot-rot, but a cop doesn't know that) good for a dime and pipe + papers, and a Liquid Wrench (similar to WD40) can that I keep in my tool box in the trunk good for a 1/2oz.

    I've been busted, and so I learned what I needed to get by which is to stick as close to the truth as possible, excluding only incriminating details. It keeps inconsistancies in your story to a minimum. If they ask to consent to a search, then I let them (they'll only get a "reasonable cause" warrant from the judge anyway, and then they're really gonna be pissed) and rely on my stash-spot to pass the test. If they ask an incriminating question, then answer with a question: "Am I suspect in a crime? Should I have a lawyer?" Sometimes asking about an attorney is all it takes to get the laws to back off, but remember that the best way to avoid a bad situation is to stay on a cop's good side, so he doesn't have any reservations about letting you go with minimal harassment - if you're an ass, then he'll sit there messing with you all day until he finds a reason to arrest you. Try not to lie in case it does go to court - you won't loose credibility. If you have anything on you when you get arrested GIVE IT UP! Bringing contraban into the jail is a felony, and you definately don't want that. Hope I've been helpful, PEACE.

    don't bring more than you can eat, but mostly, if you're going to ride with it and smoke it for a short cruise, try to avoid paraphernalia and just roll a joint. my friend once dropped his piece into his soda cup and the cops didn't find it. DONT GO TO A PARK!!! parks or open fields are major traps! they can come in on all sides and see you from a distance and hear coughing. it's the worst

    oh for fuck's sake. don't be so paranoid!!! life's too short to be worrying about this bs. if you get caught, you pay a fine. it's not the end of the world. this shit should be legal anyway! it's civil disobedience. just don't carry a lot around with you.

    just be responsible with it, if you are giong to school or work don't take the shit with you, and if you have to drive with some try not to be high before hand. only carry a small amount (personal use) if you have a larger amount DO NOT pack them seperatly you will be charged with intent to distribute. And it is a never good idea to smoke in your car. Cops are trained to spot people under the influance. so just be smart and you shouldn't have to much of a problem.

    say yes to searches? ummmm may i ask where you are from? cuz if you say yes in north america your fuckin screwed man, the only thing i can really think of is that if you insist upon public smoking invest in a dugout, (looks like a cig) and mix with tobacco so the smell is muddled.

    Unfortunately, the LEOs are being taught in academy now that refusing consent to a search is a huge red flag.
    BUT.
    They can't ask you for a search until after they've written you a ticket. Just politely say 'I'm sorry, I don't have the time, I'm late for an appointment. AM I FREE TO GO?'
    Remember those words. If you ask if you are free to go (and ask more than once, if he hems and haws about it) and he refuses, then he is attempting to detain you. The asking multiple times is to ingrain it into his memory.

    If an officer asks you to step out of your car, make sure the windows are up and lock the door behind you. The vehicle is now considered 'secured' and they require either your permission to search, something visible (like a bong on the seat?) a warrant, or a hit from a dog. However, asking 'Is there anything else, officer? Am I free to go?' Once they've given you the ticket, you are FULLY FREE to go, and they HAVE to answer yes. They won't tell you this, and have no legal obligation to do so, because if they can keep you there, and keep you talking, they can consider it 'further contact' and screw you, hard.

    Generally, what I do, if I'm pulled over (rare occurrence) is ask the officer why I'm being pulled over, ask him if I'm being cited as I'm handing him my license, and play up the very straight 'I have nothing to hide' angle. Generally an 'I'm sorry, I'm expected at x location for x reason.' Eye contact-casual, no nerves, stay relaxed and cooperative, but the first thing that I say when the officer hands me the citation, and I accept it and sign it is ask 'May I go now, officer? I'm in a hurry, but I'll see this taken care of ASAP.' Touch them with that BEFORE the officer says anything else, before they can even ask. If they do ask, simply reply you do not have the time (which you've already established by asking if you could go, because you have somewhere to be) and ask if you're being detained. The exercise of your rights isn't a crime, but the WAY in which you do so can set up huge flags.

    Oh, if a cop leans into your car, he will say he smells pot, not matter what. I've actually said 'no officer, you smell cat urine. I picked up a stray and the little bastard peed in the back seat.' This establishes 2 things - 1, the recent presence of an animal in the vehicle means a dog will go apeshit and he'll NEVER get a clear 'hit' because the dog's going to be looking for the 'prey' and 2, you're aware of an 'off odor' yourself, and have an explanation that causes 'reasonable doubt' on his 'sense check'.

    Here's what a K9 will trip on

    Scent of a prey animal (rabbit, cat, etc). Even if the animal is out of the vehicle, the dog will freak on the scent trying to find it.

    Scent of food. The dogs are trained with food- therefore it smells 'reward' and is going to go for it. (leave an old cheeseburger in your back seat, or a mcdonalds bag for THAT very reason.)

    The scent of a female 'in heat'. If you've had sex with your girlfriend in your car, the dog'll trip if it's male. (spray some doe in heat urine on your tailpipe, or on your tire, and watch the dog bat himself stupid, because now he smells 'screwable AND prey')

    The scent of drugs - permiability has a lot to do with this. A dog can't smell THROUGH anything. That's total bs, but leave it sitting long enough, and the smell itself will penetrate. If you're carrying and it's been (cleanly) triple bagged that day, (like someone wasn't sloppy about getting the nice smell all over the outside of the bag for you) the dog's not likely to smell a damn thing. The nicest setup I found was this. a can-safe, mixed in with a bunch of actual cans (not beer, for the love of god, that's an entire OTHER set of screwups you can get busted for) in the bottom of a cooler full of ice. The cold retards the movement of the volatile compounds that the dog picks up on.

    sum up-

    1st, not getting stopped

    high dollar vehicles-red flag, same with 'throwaway' 50 dollar pieces of crap trucks. plain model, no heavy tint, no bling, etc
    be aware of your driving.
    don't look like someone that'd have it. (sorry, my darker skinned brothers and sisters, cops are f'king racist.) nice clothes, look 'older' (mid 30's and up) dress 'down' Ladies, look frumpy. Guys, look straight, but don't look 'high dollar'

    If you ARE stopped,
    Be cooperative
    be cool
    answer the questions directly, but if it's a choice between not answering or lying, say simply 'I don't understand the question.' or 'why would I?' You're not lying, and you're shifting the question a bit.
    Don't 'challenge' the LEO's authority by being a smartass. Don't be insulting, condescending or rude. 'light' small talk is good, how crummy it is for them to be out in the heat, what's the road conditions ahead like, is there any construction or accidents, etc.

    Once the officer writes you a citation or saying 'I'm going to let you off without a citation this time' Thank the officer for his time and ask if you're free to go. (once the officer writes you a citation, or declines to give you one, you ARE IMMEDIATELY free to go. The reason for this is as much to confirm with the officer that you're NOT being detained, and for the benefit of those lovely cameras set up to record the action. If it comes up that the officer has said 'yes, you're free to go' and he tries to detain you, that can cost him his job.) This is one of THE most important things you can do. If you're not near the officer, talking to them, you cannot incriminate yourself, and they will look for ANYTHING incriminating.
