I was once when I was a teenager and it was a joke (so was the case against me for that matter). I actually got basically fired from doing "community service" which was fine because I didn't want to do it anyway. But my reason for wondering.....a friend is on probation and he told me (as we were drinking beers on his patio) that his PO can show up any time at his house and have him arrested for drinking a beer or doing any other thing she has ordered him not to do. Is this common? What kind of crap is that? An adult can't have a few beers in his own house?

I have never been on probation. What is he on probation for? What other "rules" does he have to live by?
I avoided probation last year by pleading guilty to my DWAI-drugs charge. Had it went to trial and I was found guilty (and I would have been found guilty according to my lawyer), I would have been sentenced to three years of probation. Instead I got the minimal sentence, which includes a one-year conditional discharge as opposed to probation.
I was on probation a long time ago, but it wasn't anything like that. They do have those "rights" now and are allowed to totally screw with your life... Depending on the case and the judge, it's almost "suggested" that they set you up for a fall. Any state that has privatized prisons will most certainly want to keep them full at all times because they have to pay the corporation running the prison for at least 90% occupancy even if they aren't, so may as well keep them full. Sucks, really
no, i've never been on probation. know others who have been, or are still on probation. for those who have the condition set that they cannot consume alcohol, then yes, if the PO shows up and the person on parole can have the parole revoked and serve time in jail. the person would be violating the terms of probation... and yes, the parole officer can show up and search the house
I don't know what all the rules are but he got a DUI. I know he isn't supposed to drink at all or be in/at bars or parties. I got the impression that the PO can make up all kinds of restrictions....like who you can hang out with, etc. One shitty thing is that he was supposed to be off probation over a month ago and have the blower machine taken out of his car but they haven't done that yet and don't seem to be in a very big hurry to do so. He said this PO has a reputation for dragging her feet and trying to bust you right at the end to keep you on paper. I think that's crap. I know the guy broke the law but he paid the price for it and I don't think people should continue to be punished once they've completed all the stuff they were told to do. Of course, he still drinks beer at home but...fuck that shit...I would too. Again, I just wouldn't do well in that scenario. I'd have a hard time biting my tongue and not saying what I really think. As for my own probation years ago.....the short story is that I was just in the wrong place at the wrong time. 5th degree theft but I didn't know about it in any way until the group I was with were being arrested a few hours later. I was 16 or 17 and got a deferred judgement which meant I wasn't convicted and if I did my community service and didn't get in trouble for a year the whole thing would just be dropped. So I did the probation and didn't even have to meet with my PO after I got fired from community service. The local police were supposed to be supervising my 8 hrs of community service. They told me that the first thing I had to do was rake the small local park. That was fine. I'd rake the park but it was going to take me 8 hrs to do it (probably could have done it in an hour). Fuck their community service. I didn't do a damn thing wrong. I was going to knock out my 8 hrs in a day. After about an hour of slooooww raking the cops told me to go home...that they didn't want to have to supervise me. And that was it. I wasn't asked to do anything else and was kind of proud to have felt like I stuck it to them. Fuck em. Rake your own damn park.
In iowa its the worst place to try and be a criminal. There are a lot of laws that are still on the books from 1800's and will cite you for it. One being that if you come up on people riding horses, You have to slow down and give them space, I don't and wont and went to court to hash it for the fact, They did not build a hard surface road for horses to be on! I walked! I had a buddy who got his second DUI and was living with me while no license and probation. They can fuck with you all they like when you are in the system, They don't need a reason. They can show up anytime, But they could not touch MY property without MY permission which was the loophole. This state will go to the extent to install a telephone at your house that also has a breathalyzer in it and they will call and have you blow. I didn't believe it until a friend had one and I stopped by to see for myself. Ankle bracelets for minor offences, But the judge seems to think you are a king pin of a cartel and track you. They put one on a 67 year old lady who bought a shit ton of items at walmart, But forgot the two 12 packs of soda under the basket. This state is ass backward and is the butthole of America IMO when you go other places. The BS they pull keeps the revenue up and people down for the fact its hard to get a job when all do background checks. They make you pay to serve time in jail. If you have a job, You have to pay more to go to work. You have to have permission from the state to sue any branch of it, So you can never win if state related accident/death/problem occurred. IMO, Fly over or drive through, You are not missing much.

This would not be ending well for me because of my utter disrespect of "authority". The only reason they get to do all that stuff is because we all sit back and take it. They are in charge because we allow it. The "authorities" may even be monitoring this post. If so, let me save you the gas money of driving to my house by saying "Fuck yourself" now. Three years plus time served (90 fucking days before trial in a county facility), for halfa joint...100$ a month in fees. They told me a probation officer would contact me when I was allowed to move to another state from where I was busted. They never did, but I paid my probation fees like clockwork and worried about it the whole time. Fucked up my life pretty bad. That was many years ago.
I haven't been on probation, but I've worked with at least two people who are or were on it at the time. It's not that big of a deal here...they drug test you MAYBE once even for drug-related sentences, and you just have to go visit with your probation officer like once every couple of weeks, pay your probation fee, tell them you've been good, and you're free to go.

I always thought it was based upon the ruling and mandated from there. If you were charged with an impaired offense it stands to reason that it might be part of the probationary period.
I agree, They are worthless Nazi's in iowa. Not there to help, But to hinder at ALL costs. If you get a flat on the side of the highway, You might luck out with a decent sheriff or trooper who just runs his lights so you are safe changing it. More times than not, He/they will want to see your info etc and maybe want to search the vehicle to see if they get lucky. The phone, Long story summed up. A buddy in his stupid youth decided that robbery was the way to go, Did well, But you cant go on robbing forever, They will catch you or the owner will shoot you. He went to the ISP and when he was on parole/probation, He was in possession of a firearm. Honestly, It was not his and was a shotgun during deer season, But you know how the pigs work and think. Back to ISP for 6months-year IIRC. Gets out again, This time he knows what he did and was going to change his ways, Well they had that planned for him 10 fold. They made him live with family down the street from my house, Cops would drive by 3 to 5 times a day/night, Dead end street lmao. Gave him an ankle bracelet that would honestly go off if he was with-in 3 foot of the road and would have to have LEO's come turn it off. They thought he was 'running' when he was cutting grass, It tends to grow toward the road lol. The phone was installed because they said alcohol was involved and 'this' should curb the problem. So he had to be with-in 90 seconds of reach or back to ISP. Couldn't even get a job! Was a real shit burger for about 18 months. Now he is free and clear and a law abiding citizen, Nothing more than a seatbelt and maybe one moving violation in 15 years. The only thing it taught him, Was to no trust, cooperate, or have anything to do or say to the cops but 'I was fucking your wife last night' when they would try and get him for something he never was around. They abused their authority toward him for a couple years until they knew he was not going to re-offend and they couldn't pressure or pin something on him. Nothing good comes from LEO's, They are all crooked looking for the next fast one they can pull and throw under the bus! Im glad he was 1 in 100,000 who went straight and never turned back. But they made it almost impossible for him for those 18 months.
