Being caught in a school zone can give you a harsher punishment. ^^^ Not to mention that he was on probation...
as stated many many many times already. It does not go into effect til 2009. That being said, he was busted in a dorm room; a.k.a. school zone which is still illegal. And on top of all that he was on parole which is a violation and a pretty sure bet he's gunna do some time.
^ he was on probation, i trust kil0's word on that they can search you whenever they damn feel like it once you're on it. also, this is america, with enough money and a good lawyer you can get off. i'm not even kidding. i've seen big crack dealers in rehab because of it. use that $ if you've got it. i'd much rather stay out of jail/prison than get kicked out of college.
i agree that dorms remove most of your rights. however, if they physically searched your body without consent or a warrant, you should have a case of sorts.
man i got busted in the dorms too. im at Wright State tho. got to go to court on the 7th so i'll see what happens i guess.
The fourth amendment came through for me. ended up getting the suppression of evidence and everything from this got dismissed. Ended up off of probation a few weeks ago. pretty ill. now i just need to figure out what to do about the lost scholarship...
wow man you got lucky... as bullshit as all that was for just weed, i'm surprised that the fact that you were in a dorm room/on probation still allowed you all sorts of rights. but anyway, nice to hear that everything worked out on the legal end. seeing that you weren't actually charged with anything, how come you were still thrown out of school? do they have seperate rules?
you should get the case thrown out, any competent lawyer can do that. then file a wrongful arrest law suit against the county the police worked for. then a personal case for violation of your person by the searching officer
