oh. so old white guy started it? i thought punk kid mouthed off to the wrong crazy old man. still kinda think so, just it's not on camera. kid's body language and crazy guy's heated behavior are situations i've been in before. then i learned not to make eye contact.
The problem with saying who starts it is that the video doesn't show what was said before this, we don't know who really brought up the subject of the shoe-shine. Perhaps the old guy just did it to get a rise out of the young one... if he did, then he started it. Perhaps the young guy and girls set this up, which is why the video doesn't start til after. Of course, it could be that they turned the camera on because she thought the old guy was going to start it. The point being, we have no clue... What we do know is that the old guy moved to the front of the bus, supposedly to get away from it. They BOTH kept yapping, but the young guy definitely was the one to start physical contact. Regardless of everything else, to me, that makes the responsibility his. I think the courts (at least here) would agree with that... I base that on the fact that any time I ended up in court and said, "He started it by pissing me off", I get told "it doesn't matter, you hit him first"
