There have been more than 1,700 cases between 1973 and 2020 in which women have been criminalized based on the spurious notion of “fetal personhood". That estimate, probably an undercount, includes a wide range of cases in which pregnant people faced arrest and prosecution based on some action or behavior that law enforcement claimed caused harm to the fetus. Pregnant women have been criminalized for falling down stairs; giving birth at home; exposing a fetus to dangerous “fumes”; having HIV; not resting enough during the pregnancy; not getting to a hospital fast enough while in labor; being the victim of a shooting; and self-inducing an abortion. America accounts for 4.25% of the global population, but imprisons nearly 1/3 of the world's female prisoners. Only 18% of those were for violent offenses. The future is scary but cloudy. The Supreme Court for the first time has taken back a right previous Supremes called constitutional and "fundamental". None of the past cases of reversing past precedent did that. This is what sociologists call decremental deprivation--losing something precious you had--as opposed to not having something you never had before. It's more acutely felt and likely to lead to anger and aggression. Whatever the legalistic rationale for such decisions, they are unlikely to sit well with large numbers of people who, according to the polls, accept these rights. And the majority on the Court that is doing it is such because three Trump appoointees ;lied their way onto the Court promising under oath they'd never do it. This behavior suggests a bold effort by a dwindling minority to cling to power by imposing its will on the majority by legal chicanery. Taken in the context of the Jan. 4 assault on our Capitol, the desperate efforts at election rigging and voter suppression, and all the weapons brandishing, it sure looks like democracy is going out the window. But demographics are against the Retrumplicans. Younger voters overwhelmingly oppose these measures and they will take over some day, one way or another. Retrumplicans may have to face the music some day.. .
