My locker got searched today, they ripped all my shit apart, and fucked up my perfectly organized locker. They demanded my car keys to search my car, and when I refused, they called our school cop in, at which point I had my keys taken from me. They found nothing, and as a restult can't make me take a urine test, but what hapened to the concept of "unreasonable searches" in our constitution, and why is a school district above the law of the land? Apparently if you are a principal of a school, you have the privelage of violating personal rights. So much for america, and our so called "rights" and so called "freedom".
In a school, you have no rights. Your home is another matter. Same applies at work. Your computer usage, emails WILL be read. Your stuff IS subject to search Don't like it, don't work there.
They had no right to search your car but the locker was legal. Yeah thats fucked up but at least they didn't find anything. Did they have probable cause?
actually the car might have been illegal.. but lockers arnt... lockers are school property and they have every right to search them for ne reason they want to or no reason at all.... the car tho might have been legal being that its on school property, but i doubt it, cause its ur car
car searches aren't illegal if its in their parking lot. and you don't have "no rights" in school, just less.
I wanna know what made them search you in the first place? Have you been busted at school before or anything?
all they need to search you at school is reasonable suspicion. which ranges from smoking a joint in the hall to wearing a hemp bracelet.
Say the phrase weed too loudly at school they'll rip all your stuff apart. I guess its goodin the sence theyll do the same when someone may have a gun, but they are just paranoid. I keep all my stuff clean for all that stuff. Not that im a huge user, but like knifes and stuff. It could get ugly quick.
not once caught for anything, not a single mark on my record. the drug dog didnt do anything to my locker or my car, but that didnt stop them. I love how students who have to be the future have no rights because they stay in school

If they had a warrent, your done. Assuming not: Does "ripped apart my stuff" mean actual damage, if so they are liable. When taking you car keys, did they reach into your pocket and take the keys out. That is searching your person, it should have been done in private. Was you car on school property?
Ya the car was on the school, it was they took my keys in the office, and the cop took them from my pocket, no "damage" but I had organized file cabinets, and pens and pencils in cups, they just like pulled all my stuff out, and tossed it all back in... they even pulled open my ti-83 calc, and pulled the batterries out, all my notebooks and books were unorganized and strewen around very carelessly. my coat wasnt hanging on the hook, they just dropped it into the bottom of the locker amongst the other items. and they dumped/tipped both of my cups of writing utencils without putting them back into the cup. im not saying the school dun have the right to search people with probable cause, but im saying they had no type of actual evidence, and my car is completely clean, and has no possessions in it, cause it got broken into last month, and ever sense I keep NOTHING in my car.
I would have demanded to call legal councel, loudly say that I did not consent to a search of my person, and then calmly walk away. When it comes down to it, they have to arrest you to legally search you. and the school can't search your car just because it's on they're property, if that were true, Wal-Mart or any other place could do the same thing. And it seems that Wal-mart is a very active antidrug warrior these days.
a school can search your car if its on their property; its different than a walmart, where you dont agree to anything by parking in their lot.
This is why they can search your car. That and at least in my school you had to sign a contract of sorts saying you have read and agree to the rules, and in the rules is where they say they can search your car or give you a breathelizer. I dont know how much weight this document holds in court, but they forced all of us to sign it. (catholic HS)
if you are under 18 then it don't matter what you sign cause you aren't capable of making your own decisions... At the first wiff of trouble state loudly and repetitively that you want your parents there, they can't do shit till/if the arrive. And if they touched you in public in anyway, call the ACLU and get a child advocate to sue their asses. Seriously, they'll keep fucking with your rights until someone stand up to it.
At my school we had to sign a paper to get a parking pass and it said they could search if they desired. That's why some kids parked in the street.
well were I'm from you sign nothing and they have no way of knowing whos car is whos unless they were to stand outside and watch you drive up in the morning. And if your under 18 anything you signed isn't legally binding, unless it was co-signed by one of your parents.
