possesion w. intent to distribute... in school

so im with my friend who sells weed, and tell him i need an 1/8th, so we into the bathroom (this was at school) and he hands me four dime bags, he was just hookin me up with the little bit extra. so as soon as he hands it to me, i go to put it in my pocket and a teacher walks in and sees it and snatched it out of my hand. So eventually i end up in the principles office, and a cop walks in, takes one look at the bags, and says that i was sellin. i told them that it was personal, and i got it the week before (id rather die than be a fuckin narc). so he asks me why i was in the bathroom with 4 dime bags, and i told him that i was asking my friend if he wanted to smoke after school. they searched me, then arrested me for poss w/ intent. and the principal is referring me for expulsion to the county board. im 17, and this is my first offense. however, my last name is mud with the law around here. you guys think i will have to go to juve?

What happens will depend on how the 'intent to distribute' charge turns out. Fight it, if you can.

i got busted at school for possession and intent to sell, i got expelled and everything but my charges in court were dropped cuz i live in a pretty ghetto place (milwaukee) and my school is in wauwatosa which would be the rich suberbia but since i live in milwaukee it was referred to milwaukee court and my DA dropped the charges, pretty cool of her. But since your 17 now (i was 16 at the time) you could be tried as an adult, and worste thing that could happen is doing jail time (trust me you'l get use it after about a month... haha) but yeah like ppl said just fight it becasue you WERENT selling. The magical words when you are busted is "i wanna lawyer", or if you are a minor "i wanna parent".
Because you claimed that the pot was yours in the presence of the police officer they can prove that you had possession. It doesn't matter that you weren't selling any, just that you had possession that was made for distribution (keep all your weed in one bag).

If you had said those magical words a good attorney would have said that the school didn't have a reason to search you in the first place, and that even if they did it would violate your expectation of privacy (especially in a bathroom stall). The case would probably have been thrown out.

get yourself a good lawyer and when people say "dont talk to the police" they mean "dont' talk to the police" (you only need to give id).

Hes gonna be tried as an adult, and since it was in school the fines double and he had it bagged up ready to sell. Hes gonna get some jail time, prob 5-10 days.

 

Yup..this is why I tell people its retarded to deal with drugs in school. Hope you learned your lesson. Plus the penalties are usually doubled or trippled on school zones..
