I was just wondering if anyone knows any laws on what happens if a cop pulls you over saying you didn't have your seat belt on at 10:50pm when you actually did have your seat belt on. Then says he smells weed, searches your vehicle after he finds the weed/pipe, he says the weed weighed out to 2.1g when in fact it was under .8 if that even. So I know it's ILLEGAL for a cop to lie in uniform where would this leave you? He Lied about not wearing the seat belt and then lied about the weight of the marijuana any help plz!??!
idk ... this is why i'm asking my main thing i'm saying is cops abusing their power to forcibly search peoples property then lying about why and how much it was

Yeah but if they want to convict him, they have to have that evidence (the weed) in court no? And if the cop is tampering with evidence, then arent the charges bogus? Talk to a lawyer...

It pretty much doesnt matter where u live u said weed is illegal there. Heres the thing have u ever heard of "probable cause" thats pretty much wutever the cop says it is he had probable cause 2 pull u over for seatbelt he then had probable cause to search cuz he smelled weed. Why would u be driving around with a weed pipe anyway? Or weed ? Unless u just picked up ...bottom line is cops are gonna lie and it will hold up in court. I would suggest that u stop driving around with a weed pipe and weed its just silly and asking to goto jail...
Further more, he probably profiled u and then thought to himself "this guy looks like hes doing sumthin wrong" and went from there it sux tht cops are dishonest and there seems 2b more & more of it these days..but in the end he caught you and that is wut the judge will look at.
And lastly, this case is not going to go to "court" because wuts gnna happen is u will hire a attorney(who more than likely plays golf w/judge&prosecuter) & he will advise u "its in ur best intrest to take this plea agreement" tht the prosecution has offerd you will do little to no jail time forfiet ur bond money & b placed on probation which will include manditory fun activities like substance abuse classes that u will have to pay for....
which will end up with you as part of a statistic showing how addictive weed is, because look how many people go to rehab for it!
When you act illogical, illogical things happen to you. Don't put your god damn weed in your car. The roads are their land. They shoot first and ask questions latter. If you're gonna live in the system it's in your best interests to be consciously aware of it.
As people have said, Cops lie all the time, and it comes down to your word against his. Do your best to minimize the impact on your life in court, and chalk it up to lesson learned. No reason to drive with weed, but if you must keep it locked in the trunk and don't give cops reason to pull you over.
i bet the cop ASKED you to search your vehicle, even if you didn't realize it was a request, not an order. next time, politely say "no, i do not give you permission to search my vehicle." try not to be intimidated into submission. much of their power is determined by how much power you give them.
I don't know if he needed consent to search your vehicle if he smelled weed, but you should have made it clear that you did not consent to a search of your vehicle in any case. He would have gotten real nasty, threatened to call in a K9 unit to search, may have actually gotten a K9 unit to search - in which case you're fucked either way, but never give your consent - there's really no point in making it easier for them to arrest you. As far as the seat belt thing - cops lie about this kind of stuff all the time. I got pulled over once for going "15 miles over the speed limit". I know I wasn't speeding, because I NEVER speed and I had the cruise set. Cop asked me to get into his car while he wrote up a warning - I looked at his radar detector and it showed that I was not speeding. I didn't say a word, and I got off with the warning. If I had been stupid and pointed out his obvious lie, I would have gotten a ticket. He saw a car load of young people and pulled them over - it's that simple. You basically are at their mercy here - because even in court, no judge will ever side with you on this point. Always remember, this is a business transaction - fines are a source of revenue. Like porkstock41 said - never consent to a search of your vehicle - there's nothing saying that even if your car was clean that they wouldn't plant something. Don't be a dick about it, just make it clear that you don't consent and then shut your mouth. If they start asking you a bunch of questions, ask them if you're under arrrest, if they say no, then ask them if you're being detained, if they say no, then ask them if you can leave. They can't hold you unless you're under arrest or if you're being detained. In either case don't let them engage you in a conversation. You do not have to communicate with them. Moral of the story - you drive around with weed in your car, this can happen.
2nd moral - use your right to REMAIN SILENT if you do get placed under arrest. they usually imply that "co-operating" will make them go easy on you. this is FALSE. let them call the fucking drug dog. they are likely bluffing about that. but if you call their bluff and they DO call in a dog, and find weed, you are at the same spot you'd be in if you let them search and they found weed (if you lied about it being there). SOME cops might go easy if you just admit to having weed in the 1st place, but don't count on it. don't consent to a search don't incriminate yourself you can ask "do i need a lawyer?" to make them stop asking you questions.
A good one is use common law, you caused no damage harm or loss to another individual there for no 'crime' was committed.. if you have a court hearing dont turn up then they cannot pin anything on you. ~that is how it is in the UK not sure about the states ... good luck ... just remain true and you should be ok ..
