And I'm only slightly freaking the fuck out. The deal is that Saturday night, one of the ladies on my shift cut her thumb wide open on a can. Usually the protocol for such an incident is to fill out an accident report and call the on-call nurse before you let them go to the hospital. The accident report was no problem, but I could not find the nurse's number for the life of me. I even wrote that in the report. Then I find out today that we (the other team leader and I) may lose our jobs because we didn't call the nurse first. Okay, I'm sorry, but if someone is really bleeding and I cannot find the number, I'm not going to make them stand there and bleed to death waiting. I just told her to go. The accident report says that it must be filled out and faxed within 24 hours of said accident, and it couldn't be completed until she returned from the hospital, but it was faxed in within 24 hours. The only thing that wasn't done was calling the nurse, but like I said, I could not find the number. That number should be posted somewhere EASILY found because in an emergency you don't have time to look!
you'll only lose your job over this if they already wanted to get rid of you and have been waiting for an excuse.

I'm fairly certain that's the case...but it looks like I have a good case for unemployment if they do. And no, I haven't found, nor posted the number, because the accident happened at 10:15, we were under strict orders to be out of there by 11:00, and I was off today (Sunday, technically). And it's not MY mistake, the number used to be posted and someone took it down. If I printed it out and posted it now, the company would use that against me and say it was posted the entire time. They're snakes like that. But I will be reporting them for all the 8+ hour shifts I worked over the YEARS without breaks.

Well, they'd better be smart enough to know if I lose my job, I'm spilling the beans about every little illegal thing that goes on in that place. And there are a LOT of them.
isn't there some kind of loophole that allows them to do this? i know i've never been offered a break since i first got into the food industry over 5 years ago, i've worked for several companies in that time, and at least a couple of them were very strict about following every applicable law.
Wow. Apparently if you're over the age of 18, you don't legally have to have a break. What a load of fucking shit.

As far as I can see it is THEIR responsibility to make sure the number to call for first aid is easily available, kind of a no brainer really. Not sure if it's the same in the US but of here health & safety would have them for this. This is not your fault and if a company sacked anyone for this in the UK they'd be very foolish indeed.
You've been there forever, Kinky, they are not going to fire you. They can't afford to lose the lifers. (I worked in a coffee shop for years and it was the same way) So if someone's arm in hanging by a thread or there is a shooting, you can't call 911 until the forms are filled out? Who is your Health and Safety person? This is their problem that the number was not available. There is no way you'll get fired, even if they would have fired someone else if it was them involved. You're too valuable.

The sad thing is that corporate has been threatening to fire people left and right lately. I've seen them can some really good ones. I'm so scared that I'm next. I really think it was just the bitch who was running the day shift running her mouth trying to scare me and the other guy, she told me they were threatening to fire us over refunds the other day and I had five on my shift and didn't even get talked to over them. But it scared the hell out of me and I can tell you I'm going to be reporting that to the higher ups if I don't get in trouble over this. But the thing that bugs me the most is that the nurse's number used to be posted in plain sight. It's not one that I've ever had to call before, so it's not like I had it memorized. And the fact that my other team leader on shift would have had NO clue what to do if he was by himself. He's never even been trained to properly handle an accident. I'm fairly certain being fired over this would be wrongful termination and that we'd definitely get unemployment. It's 8 AM here and they don't start doing stuff at the store for another hour, so we'll see. But I'm so sick of it there that maybe a chance at receiving unemployment for doing nothing for awhile might be a good thing. And I was planning on starting my new job search in January (to avoid getting work as part-time holiday help), this might end up just being a kick in the ass to start sooner.
Good way to look at it And yes, it may be a blessing in disguise. If you end up losing your job, look at it as an opportunity, instead of a setback. Shit'll work out
If they terminated based upon this information, you have an actionable case against them for unjust termination of employment. Policy does not take precedent over reasonable medical treatment and decisions that need to made immediately to ensure the safety of a worker. You are covered under federal workplace safety standards. That the initial accident report was filled out immediately is in your favour. Medical care takes precedent over legality of forms. Anything that they say regarding this have them put it in writing. If you have a personal recording device, use it. They can not terminate you on this alone but that does not mean they will not do so on other grounds. If they do that you still have a case based upon the timing of the termination. It will be seen as punitive. When you know more, I will assist you if I can. Hang in there.
This "on call nurse" thing almost sounds like the corporation is trying to hide the number of accidents that happen. Like having a mafia doctor removing bullets instead of going to the hospital.
