There is a difference between executive privilege and attorney-client privilege. I understand Trump wants to protect documents taken by the FBI from prosecution. As far as his executive privilege goes, his ended when he lost his job. He had privilege to see these documents; but the privilege expired and should not have taken the documents home. The special master should be able to go through all FBI boxes in three weeks or so. After that, Trump cannot appeal the issue, because the judge gave him what he asked for. As far as executive privilege goes, what has he to appeal? He is no longer president.

Trump's legal team could use other delay tactics, such as requesting that the whole DOJ team that is currently investigating the secret documents be recused by claiming that they may have been tainted by seeing Trump's personal information that was interleaved with the secret documents. Trump's team could argue that a new DOJ team should be formed and start the investigation all over again. That request could be made later after first having a special master go through the documents which may involve a lengthy fight over the selection of the special master.
