why is it illegal to posses drug paraphanalia

so why is it? if you can buy it at a shop then why is it illegal?

 

Im pretty sure its legal to buy most drug paraphanalia as long as there is no resin of pot on it.

 

Unless its got resin in it, they cant really do anything. Unless you get caught with it underage, or at school or something. Cause if you have noticed, or maybe its just around here or where ive been, at headshops they put pipes are for tobacco use only.

 

yup what u buy in a head shop is conciderd tobacoo smoking products. and only illegal if they have resin in them

 

yeah its definately not illegal to posess a pack of papers or a pipe with absolutely no resin at all. So if you buy a brand new pipe and its got no resin they cant legally do anything. Just tell em its for tobacco use only, and they'll know they just caught you at the wrong time ha ha.


But you got about 5 years to go before the shits legal for you Salad, so I'd watch out.

haha that definately sucks. But think of it this way, if shit like papers was illegal, you think they'd sell em at every convenience store in the united states?

 

papers are legal, everything else is not. in canada, we don't live under draconian laws....in the states, thats another matter. parephenallia has recently been made illegal in many states and i THINK federally thanks to Mr. Bush, regardless of whether there is resin in it or not, head shops can be raided and charged for selling paraphenalia...

take tommy chong as case and point...he was recently released from prison. tommy's face was used for a internet distribution gig called, tommy's bongs, or something like that....at anyrate he didnt even own the site, and all the site did was sell pipes and bongs and papers...not actual pot...BUT since tommy allowed the site to use his image, he was one of hte people charged when the place was raided. he went to jail for a long time...so don't think you're safe just because you havent used your pipe yet

 

actually his son runs the company and the police ordered a bong form the site to be sent to PA and the processor didnt check the destination and so it wasnt entrapment. Tommy was only arrested because they told him either he could go to jail(putting away an icon would do alot for the cause) or they were gonna prosecute his son.

 

I think people get a bit confused by this stuff.

Glass pipes and what not are NOT illegal in most states, or on a federal level. BONGS ARE ILLEGAL, "Waterpipes" are not. Some states have outlawed ALL water pipes, but this is not the case most of the time. Some states have outlawed metal pipes and the like as well.

Many Headshops are raided for selling glass pipes to states where they are illegal. Thus they are breaking the law, because the shipped the Bong to a state where the item was illegal. Or they get in trouble for calling them Bongs, instead of water pipes. This is why most headshop owners get testy when you call them Bongs.

Like I said, these things are legal in MOST states. If you live in one of these states, none of it is illegal unless there is resin in it. Resin is a form of Marijuana, Marijuana is illegal.
