How should I plead?

I have to go to court tomorrow. It's my first offense.
I had a party at my apt, cops came, my friends were all drunk n rowdy..i shoved them inside...closed the door and talked to the cops outside alone. I had been drinking, but they didn't actually see me with a drink in my hand...they gave me disorderly conduct and possession of alchohol...
they also said i was really cooperative and bla bla bla
so, how should i plead? cuz they didn't see me possessing alchohol, but i told them i had had a few drinks...i dont know. i hope they dont fine me too much

 

umm............... guilty for disorderly conduct but not guilty for possesion then counter-sue for more than you should and make some $$$$$

or do what I would do
plead guilty and make it less complicated

talk to a legal-consultant or something......

I lived in employee housing in Keystone, Colorado in 1993. I got busted for underage drinking and just went to court and plead guilty. They tried to nail me with 100 hours of community service which I thought was BS. I also was 17 and heading back home to New England in about two weeks as I was only out there for the summer. I went and spoke to the District Attorney afterwards, plead my case, let him know that I was 100% agreeable with the cops, never made a fuss and I got my penalty reduced to 1 hour of community service which he told me was the smallest penalty ever assessed in Summit County possible. I ended up doing the community service at a freakin' petting zoo.

So, I got off light in Summit County by sweet talking the DA. I don't know if this story helps you much, but just some things to consider. Good Luck!

 

No way, all your lawyer or whatever has to do is ask if they saw you with anything they'll say no, but blah blah blah and it will be dropped.

 

yea i was thinking about it...they didn't see me drinking...i admitted to it...fuck..this sucks ass..any more suggestions? i got 5 min.s before i gotta go home from work.

 

did they have your ID or anything when you admitted it?

per chance, have you been up to the cabin in Montezuma? Hard to get to in the winter as its like 3 miles down a jeep trail which I doubt is plowed in winter. Anyway, this guy Casey used to live there for a few years and we used to throw down up there - all of the employees from Keystone would party up there. Hah, suprised I even remember as I have never seen any place in my life that had as much LSD going around as Keystone during the summer of 93 in Sunrise Housing.

Yeah, talk to the District Attorney. Plead no contest and if whatcha get is bad, go talk to the DA. Ya never know, you might luck out like I did and have to work at a petting zoo for an hour.

It's sad you can get into trouble for drinking in your own apartment at 19.

 

yeah. I got in trouble for that and my friends weren't even rowdy!!

Anyway, if the cop wrote that you admitted to drinking yourself, then you have to plead guilty. If he didn't and you can afford a lawyer plead not guilty. Remember that pleading not guilty can be a big pain in the ass and if you lose it wasn't worth it.

if you havent been to court yet it will be an arrainment they read the charges and ask if you would like to proceed today or if you want a attorny i would not waist my time getting it continued before court starts try and talk with da he will help you understand the proceedings some courts will not eccept no contest pleads just be nice you my get it dissmissed and not even have to talk with the judge good luck

 

Well, things went ok...I didn't even see a judge. I saw the DA...they dropped my disorderly conduct, charged me w/ posession/consumption...then i just paid them $80 and went on my way...didn't get my liscence taken or anything...so it wasn't bad at all.
My roomate, however, got his posession of paraphenelia dropped, got charged w/ disorderly conduct (for having the tv too loud..wtf is that??) His fine was 100 bucks...but he's broke...payment plan...gonna end up costing him 150 bucks for watching chris rock too loud...that's crap. It would've been cheaper for the paraphenelia charge.
And this girl that was there...had been charged w/ possessing an ounce of pot..only got a $80 fine...
What a great law system...
