Was this illegal for the police to do?

    Alright so me and my friend both have LEGAL cannibus club cards from California. Cop pulls us over after he is burning with another friend in the car and I am "sober". Supposdly the county laws override the state laws and Cannibus cards don't work in the San Joaquin County. Well Doesn't the law system go in the branch Federal > State> County Etc Etc? They also made us throw away the 2 G we had with us. Also I had another 52 G in the trunk would that be legal to have if there is no scale or extra bags present?

    Counties can make their own laws. That's why all States allow alcohol, but there are plenty of dry counties that don't.

    Yea but doesn't state laws over ride county laws?

    Heres something from prop 215 that is making me say this

    It is mandatory that all counties participate in the identification card program by
    (a) providing applications upon request to individuals seeking to join the identification
    card program; (b) processing completed applications; (c) maintaining certain records;
    (d) following state implementation protocols; and (e) issuing DPH identification cards to
    approved applicants and designated primary caregivers. (ยง 11362.71(b).)

    Smaller governemental bodies can add laws, they can not take away higher level ones.

    Pot is still illegal at a federal level in the us, that means federal officers can arrest anyone for weed, regardless of their state allowances.

    You MAY be able to beat federal charges in court because of state laws, but only if the feds allow it.

    Or at least, that is the way I understand it.

    Did he see the 52 g? because I dont think that is a legal ammount even if you have a card.

    If it was state, county, or city police, they are out of their durisdiction. Thru had no right to do that. If it was a federal cop then yes they could of arrested you on the spot. You know that you could take this to court, and file a lawsuit against the county. They actually
    Broke the law. Not you.
