This has been a very popular technique lately. They stop you for something, arrest you then go thru your phone log. Very similar to how they search your history on your GPS so they can see where you've been. So if you're caught with drugs, they can trace your steps back to where you got them. Technology is a double-edged sword. Use it wisely!

What worries me is what's next? What if your busted with your lap top or I Pad? Do these count as being in your possesion and if so, does the same ruling apply to them. The one saving grace is that alot of the California Supreme Court dicisions are over turned at the Federal level, but until then password protect your phone and invoke your right to remain silent. It may not stop them, but at least they'll have to work for it.
No, laptops are not part of the ruling. In fact there's an easy way around this, just don't have your phone in your pocket(though if you're not in a car that's pretty much impossible). Police have always had the right to search a person's personable items that are on them when arrested which until the last decade generally only involved the wallet since that and maybe a small phone book was all people ever had in their pockets. It doesn't matter though, it only applies to people in California for now. A court in Ohio recently ruled the exact opposite so it's going to go to a showdown at the supreme court eventually.
Yeah, if you get arrested, everything on you and in the place you get arrested in are getting searched... Don't discuss illegal things via text, and TRY not to use code either... ie, say you need to see someone, don't say that you need a green day CD....
Honestly if I was a judge I'd probably rule that police do have the right to search the phone of an arrested person if it's not password protected just based on prior case law. I'd also say in my written opinion that the pace of technology and current ability of cell phones has far outpaced legislation related to the search of personal items and that the legislator should make efforts to pass a law to protect the privacy of the electronic devices on someone so courts don't have to make decisions on prior legislative and case law that was written/decided before the information age.
This will be like the phone tap thing in Shrubby's reign. Now I must fill my phone with perfectly legal shit to fuck with the piggies.:devil: Don't plan to be arrested, but if I am I might as well have some fun.
