Wimet undercovers raided my house for meth and a grow op

Around sept. WIMET drug squad came in without a warrent (my grandfather let them in because he's very well known around the community and respected and he also knew there was no grow op or meth lab in our house) after staking out my house for atleast a couple days (reason I know is because a friend works at a gas station and actually talked to the cop but I didn't talk to my friend until after this happened) and they were looking for a meth lab they said and a growing operation. After searching the whole house and basement/crawlspaces thoroughly they searched my room and found a pill bottle full of stems in a drawer and a pill bottle with someone else's name on it under my bed with like 12 grams in it. They also had me empty my pockets and found my scale but gave it back. I didn't say anything or acknowledge the undercover female who found them so I didn't admit anything.

A couple weeks ago I saw my P.O (I've been on probation for about 5 months for the only charge i have currently a possesion of MJ and got 4 months left) and she saw on the computer that I had a warrent and I knew it had to be for this but I just denied knowing what its about. She had a police officer come get me and take me to holding cells while I waited about 2 hours for a PR bond (jails pretty damn full here) and got home.

I have court for my Arraignment on thurs or friday and I don't think I'll goto jail then but maybe on my judgment.

I see my lawyer tomarrow he's pretty damn good but anyone have any tips on what to discuss and I think I'll be pleading not guilty.

Dude, they have a warrant searching for whats on that warrant.. whatever else is partially inadmissible and you could suppress that evidence.. its difficult to say what your circumstances are..
You have already been detained once, they may have given you a short leash and its possible you have pulled on it..

If you're on probation, they don't need a warrent to search you or your property.

The last time I had cops come through my place (4 or 5 years ago now?), when they knocked on the front door and I opened it, they were damn near choked to death from the weed smoke...

They asked me if they could search. I told them POLITELY, that although I was more then happy to let them come through and search, that for everyone's sake, it would be better if they got a warrant.

They did so and proceeded to search our building. They found nothing really, some paraphernalia and a tiny roach.

I didn't get charged with anything (it would have been thrown out in court and everyone involved knew it) AND more importantly, I didn't give the cops any reason to make it personal...

I could have been rude and told them to fuck off and get a warrant... I could have lied and told them that no, it wasn't weed smoke. The only thing that would have changed, is they would have come in to do the search pissed off...

Yes, there are a lot of real fucked up cops... but there are also a lot of ones who just get caught up in the "I hate cops" shit... If you have an attitude about cops and you show it to them, they WILL want to find out why. Piss them off and they will try very hard to find something to charge you with...

Be polite... stand up for your rights... and most importantly, DONT MAKE IT A PERSONAL CHALLENGE to them...

If you think they are violating your rights... don't scream, don't yell, don't tell them you are going to sue them or get them back or other stupid shit...

Smile inwardly, and call a lawyer afterward. If they did violate your rights, you will walk, on pretty much whatever you are charged with.

As for the people offering up specific advice as to the laws... Unless you are quoting the laws from the same place the person lives, you aren't helping them at all. From one state to another (or province) the laws change, yet there are people quoting laws from whole different countries... lol

 

In Burma if you refuse a search you go to jail for longer than the crime they are searching for...so...ya...if the OP is in Burma,he is fucked

 

Finding 12 grams isn't sooo bad. But you've been detained before so that's the issue. You don't have room to play and get caught.

 

Why the fuck were they looking for a METH lab in YOUR house?

 

Ah well who knows but I was talking about mescaline and how I was going to have a bunch at a someones house and I think one of the kids hangin out there snitched when he got pulled over and he thought I said "meth" cause he didn't know what mescaline was.

well this just sounds horrible as hell. its getting old, cops and their meth accusations now. i think they just pull those accusations out of their ass just to get a judges attention to sign the warrant. its bullshit.

 

Which is when you go after the warrant instead.

 

It should be noted that on top of any new charges you're probably going to get a violation of probation charge too.

 

Yeah I've already thought of this but the prob. violation will be judged after this case (couple months) because I am not guilty nor not guilty at the moment therefore it will be postponed.

Yeah I got 4 days on my arraignment but got bonded out on thanksgibbin with a $800 bond. I go back to court tomarrow for my PO violation and the 8th for pre-trial for the possesion which will most likely be dropped or dismissed due to the fact that the pill bottle with the bud wasn't on my person and had someone elses name on it. And I have the best lawyer in the region n he's gettin paid a grand for all this.
