I was just arrested for possession or possible possession of paraphernalia, they found a small gram and a pipe which had salvia in it. My question is, does anybody know, or are there any links that can explain to me the NJ laws because they searched my bag without consent saying probably cause was the pipe, which was openly sold to us in AC and it had legal salvia in it. So I just need some clarification.
go on norml.org uhh you will probably just get a fine of $1,500 - $2,000 or that + conditional discharge at worst lol. did you give them a "reason" to search your stuff? that is for marijuana though, salvia i am not sure if it is legal to be smoking in NJ just the plant itself is
It doesnt have enough info what I really need to know is- is the fact that we were using a bowl "considered drug paraphernalia" for legal purposes (the bowl has salvia in it but maybe res of pot) enough of a cause for them to search my bag without consent, because I specifically told him I dont consent to any searches. He said the fact I had a bowl in the open meant he could do whatever he wanted, but I asked him if we were being arrested or detained and he didnt tell me. Basically, the law is BS and he just forced his way.
How did you acquire a pipe and salvia being under 18? You will probably get in trouble for being underage, but there is no drug charge here.
every single fucking store in AC sells pieces and salvia to you if you are a reasonably old teenager, I'm only 15 and probably 8 stores offered it to me. we bought the bowl and the salvia and thats what they saw us smoke, and they used that "possession of paraphernalia" and accused us of the bowl smelling like weed when salvia was in it (but there is some res in it as well) as grounds to search our bag which had the bud in it.
