Hey everyone, I have a serious problem. I have a really annoying neighbour downstairs who complains to my landlord about noise sometimes when my husband and I have sex. The complaints are entered as "exercising" noise. Honestly, who exercises at 2 in the morning anyways? I don't think we are being very loud, but then again we are lost in the moment. We got our third complaint today. My question here is, what are my rights as a tenant? I don't think they can tell us when we can and cannot have sex. Could we be evicted over this? We live in Toronto, Canada, and I'm sure it varies by municipality. I have read all of the noise by-laws and there is no mention of noise due to good lovin, the closest thing mentioned is music playing. And that's not the same thing. Anyone have any words of wisdom?
i can't imagine your neighbor complaining unless it's bothering him somehow. maybe he works early and doesn't want to hear you screaming and bouncing the bed in the middle of the night when he needs to sleep. i don't know what the laws are, but it seems reasonable to try and be a decent neighbor instead of basically saying "yeah, i keep you up all night, but there's nothing you can legally do about it. nya nya."

I think it's all down to compromise. I can tell you it's fair enough to have sex, a little noise cannot be helped and they should be aware of that. However, 2AM is quite late and maybe you should think about having sex at a more decent hour, some people are very light sleepers. I'm not, so I wouldn't care, but some get woken really easily. I tried to answer that as objectively as I could.
No, you're not alone. But I do have a BIG problem with being woke up in the middle of the night, and loosing sleep because of neighbours before I have to get up for work!! e_e
I agree with you underwear, my neighbors are old fart meth heads that like to scream at each other and their dogs at 4 in the morning. I have walked over and talked to them nicely I sent them a letter once and yesterday i actually woke up got dressed and walked over there and cussed them the fuck out and told them that if they wake me up again I was gonna call the cops on their crazy hoped up asses. No noise and screaming this morning so I am keeping my fingers crossed. Good luck
At two in the morning it would be the decent thing to do by keeping the noise level down. As much as you may not like the idea, we all do have to share the planet. Some people have to get up early for work, some don't, but one should at least try to respect other people.
Thanks for all the comments. We are not getting evicted, thank god, and we plan on trying to keep the noise to a minimum. They just told us to shut up lol. We just don't realize how loud it can be since we never hear our neighbours. But I do feel kinda bad for keeping people up, it's not a nice thing to do. I'll just have to ask the hubby to go a little easier on me lol.
Lmao I probly would have asked to join in by now myself. Hell if people are gonna be that loud and they know I can hear, they might as well let me in hahaha. Good suggestion
