Please help..need some clarification on MJ Possession Laws!

    So if I get searched in Denver and the Neo-Nazis find a little under 1 oz herb on me... I get charged with the state crime and ticketed for 100 bones, right?

    Do I get cuffed and led away ...or just ticketed an released ... like a fish?


    Thanks for any clarity you can provide.

    Just a ticket, you would have a minnor violation that would go to a local court, if they wanted to then charge you by state law, they could in theroy but I doubt that would happen, They are lookig for dealers more then the end user.

    Fine is $100 I believe. I have had a few friends caught with small ammounts and the cops gave them the fine.

    Isn't that the highest they can give?

    My limited understanding is that Denver Local law makes possession legal...but the cops charge you with the state law (which carries a maximum fine of $100).

    Please correct if wrong...

    that's the highest for a first time offfence, if you get caught more then once it can varry.

    It's a low priority though like I said. It really depends on the cop, some of them go with the new laws and don't care and some are still very much a fan of breaking your balls.

    By denver law if you are 21 or older you can have one OZ or less, but yes by Coloraso sate law you can't have any.

    Remember that is Denver only. Boulder has no decrim statute.
    Plus, any officer has discretion. Thinking of them as people and treating them with respect goes a long way. Calling them neo Nazi does not. I've tangled with neo Nazis and the police are much better to deal with.

    Can city law 'trump' state law? Can you have a city law stricter than state law?

    I'm bettin that CO police area easier to deal with than the redneck pigs in the South and Midwest.

    I loved Denver! Before I went to Owesley's I'd never been to a bar where you could smoke openly! It was like being at a festival but even better. Someone had a nitrous tank in the back and people were walking around with balloons in there hands. You don't even see that at Schwagstock!!!!
