oh no's it happened

Well me and two friends were goin to campus just to walk around so we took a drive over there after smoking. Anywho right as we enter we were blasting some tunes, and saw a cop so we turned it down real quick and went down the street and parked around the corner to get out and walk around. Anyways, I start to get out of the car and I hear get back in the vehicle, I look back and flashing lights are everywhere. we got pulled over for tinted windows. My friend who was the driver gave his liscense to the nice lady cop, and so did I. My friend in the back didn't have his ID. Anywho about 5-10 minutes later another guy officer comes up and says "i'm going to run my K9 around you car, turn on your vents and rolled up the window." and they did that. all without never reading us our rights or asking for a search or anything just out of nowhere. No warrants or anything. The dog walked around and stopped at my door and just looked in at me barking but anyways, they take the driver out and search him and find weed in his wallet and cuffed him and put him in the car. So then they ask us if there is anything in the car and I told them under the seat then they got me out and searched me, then my other friend, then I got arrested, but my other friend got told to walk away and that he was very lucky. well we got bailed out about 5 hours later, and today had court. The driver had a class b misdemenor for cannabis possesion, less than 2.5 grams. Now here is what gets me, I had less than him, NOT ON ME, under the seat, and I got class b misdemenor 2.5-10 grams and a class a misdemenor paraphanilia charge. Nothing was on me or in my backpack or anything just under my seat. I don't understand, I had less than him and I get 2.5-10 grams? he gets less then 2.5? here in illinois its a bigger fine and penulty if over 2.5 grams, and I AM 99.9% POSITIVE I had less than my friend, this is BULLSHIT, we didn't do anything wrong but have fun. Anyways I got court again in july... This sucks, anyone know what I could do to maybe put these charges down or prove that I didn't have that much? idk im a little tweeked still so yea...

 

Man fuck the police, and fuck the idiots that we let make laws in our countries...I am really tired of hearing these kinds of stories. Good luck bro, maybe get a lawyer and tell him everything you have wrote here.

 

yea man, sorry about the big block of txt, i'm just a little freaked still cuz I just turned 18 not that long ago, im still living with my parents, I don't want to get them in trouble because of my stupidities, they would never forgive me if they knew about what happened, I have no job, no money, and this certainly doesn't help that at all... I have no faith in the world if they are doing this to kids who havn't done anything wrong at all, except maybe for DWI/DUI, which my driver friend strangly didn't get or even got mentioned to about.

 

also, paraphinilia charges here are way more than possession of the actual drug, minimum of $750 fine, im actually more worried about that charge then the actual weed charge. This is all just the most retarted shit ever. I want to tell my parents but I just can't get myself to, they won't do anything but probably kick me out of the house, then i'll have nowhere to go...

Aren't you allowed a public lawyer for free though? If that's the case then they'd definitely be able to help you out more than we can.

 

First off, you screwed up in every imaginable way here. The cops followed procedure to a "t" so you better get a lawyer to get a plea bargain. I'm making a few assumptions here because your story is incomplete but it goes something like this:
1.You decide to smoke in a vehicle (assuming that is the reason the weed/paraphernalia was still in there).
2.You decide to drive said vehicle (most likely having a lingering scent of marijuana) towards an area where you KNOW there will be more cops.
3.Not only are you playing your music unreasonably loud, you are riding in a car that clearly has legal issues with the tint. If you are going to do something illega, do them one at a time which means don't ride around smoking in a car that has ANY reason to get pulled.
4.One of your friends is not carrying ID. While this isn't the end of the world, the simple traffic stop could have been a lot faster if he would not have had to call in your friend's information.
5.The marijuana/paraphernalia you are carrying in the car is not secured in a LOCKED compartment. A locked compartment requires a search warrant to be opened.

Being read your Miranda rights is for after you get arrested and the police are about to QUESTION you. This is the ONLY time they MUST read these rights. They did not search the vehicle, they brought a dog around the vehicle. Any positive reaction from the dog towards drugs in the car gives them the right to search. While you were not in physical possession of the stuff under your seat you retain constructive possession because they were within your reach and most importantly UNDER YOUR SEAT.

As far as the amount you were charged with, you'll have to ask the judge to have the evidence reexamined if that is even possible. Here is your only chance to get the charges dropped because evidence is commonly lost at the stations where the evidence is stored. Even if they are able to find your marijuana and weigh it, you can bet by the time the judge orders them to reexamine the evidence your marijuana will have lost a considerable amount of moisture and could weigh much less.

If you really want to fight this, don't waste your time with some overloaded public defender. Drop the cash on a decent lawyer and you could walk away from this with a slap on the wrist/community service/probation.

 

You got to keep your mouth shut. You might be able to beat it or get charges changed if you are under the 2.5 grams.

Damn dude, that totally sucks. Remember the old drug czar saying something like "people getting arrested for marijuana possession is unheard of" and you had fucking 2.5 grams? That is totally fucked up... As for you and your friends sentences being different, thats something that happens with allot with different things. Theres allot of shit that goes on in court, if your friend had a lawyer, and could have worked out a deal with prosecutors. Seriously though, I've always thought the american legal system is particularly half ass. And why is it that american courthouses tend to be pieces of shit, like their about to collapse, fuck, I remember the cincinnnati court house lobby has fucking magazines from the 80s. And one time I was in court, and the courtroom was undergoing some sort of construction. Like a tile was off on the ceiling and there was a latter and extension cords. Half way through, a Mexican construction worker fell from the ceiling, and was like "pardon me senior"... no that really didn't happen, but it sure would be awesome if it did.

I don't think I deserve any of this. I've never sold the stuff, i've only smoked it, but what made me mad was how when i got into jail one officer was talking to me then looked over at another one and gave him a high five saying "You really got them good, you had it all planned out perfect." were they watching us or something? There was no point let some kids have a little fun ya know, they were talking to us like they expected us to have pounds or something.

now i feel like im being watched, i see cops everywhere, in places ive never seen them before, and an undercover came into my friends work while i was there yesterday he had a gun, but it also looked like he had a wire, and he was making strange conversation with my working friend. I feel like a huge invasion of privacy cuz they think im someone im not

Some points though:

1. Cops don't have to read you your rights, even when you're being arrested, only if they plan to interrogate you. I'm going to repeat in big letters since every thread in this forum is people saying "cops didn't read you your writes, you're fine"

2. You don't need a warrant to run a K9 around a car, if the dog smells something that's automatic probable cause.

 

LOL if a K9 hits on a locked box, I bet they can open it without a warrant.

 

I agree with everything Marcos said.

I say just keep pushing back the court date. When in court maybe you could claim that the pot was not yours and probably was under the driver's seat. Ask to re-examine the evidence like Marcos said and maybe you will get a lesser charge.

I would say hell yes use every dime you have to get a better lawyer...but it looks like you have no access to money. That sucks..just tell the public defender to push back the case and make sure you are not late to court or any of that shit.

From personal experience I would say take a trip to court before your court date so there is no chance of getting lost and being late.

 

Dude you fucked up and you cant get out of it and Geprodis that's fucked up to man say it wasn't yours and pin it on a friend and in the first place your shit should have been on you not the floor man Ive done some dumb shit while I was pulled over but I never put it on the floor Ive ate shit when I didn't even have to but sometimes you do

 

Yea, I thought the same thing about not getting read my rights, total bs though. In any case it's probably best just to keep your mouth shut.... I found out the hard way
