So my friend went to some dudes house, and the dude in there is raping this girl that he knows. A bunch of other shit happened, and my friend ended up taking a bat to the dude's back. He got pretty badly injured, but nothing life threatning. He got charged with home invasion, assault with a deadly weapon, and some other shit I think. Is he basically fucked, or is there anything he can do to get some of the charges dropped? There was witnesses too.
He can say he was saving a girls life. Seriously, unless the judge is a douchebag he should get his charges dropped, he put his life on the line for a girl.. pretty heroic to me.
If the guy was justified then he can be protected by the law. It all comes down to the witnesses at this point and I would be willing to bet the key witness is going to be the girl who was getting raped. Personally, your friend would have been better off if he killed the guy with the bat. I can't stand scumbags who think rape is any kind of fun. Anyway, if the guy was dead then he can't go after your friend in court. I would advise your friend to make sure the girl presses charges against the dude for rape so that it's on record otherwise your friend could be fucked because then the assault will not be justified. Just play it by the book and tell the story as it happened. Your details were a little light but if he gets a decent lawyer he should be able to get the charges either dropped or reduced. He needs to get a lawyer right away. It's possible I have no idea what I am talking about. Is your friend under the age of 18? If so there are a whole other set of rules but for the most part there is such a thing as a justified attack.
We don't have the full story here. Has the girl pressed charges? It sounds like she hasn't. If she presses charges then it was justified (and he has a case). If she doesn't press charges then your friend is in trouble. If she doesn't press charges the you better hope that she at least shows up as a witness for your friend.

I just talked to his sister, and she said that the girls and his story matched up to the cops, so thats another plus.
Well, he certainly needs a lawyer. Shit like self defense, or defending someone else, is ridiculously difficult to ague in court, which is one reason why I think the american legal system is fucked up. Its normally a good bet to get you own lawyer, not have one appointed. Generally appointed ones aren't bad, but you can always get screwed over with a bad one. Does he have a previous record? Say he has a previous assult charge, that will not look good.
