So my boy gets bagged last night; charge is PL 221.10 01 (not sure if the 01 is even relevant? Isnt listed in any of the lists of top offense charged i've found - thoughts?) He had a pipe - a tiny ass bat (half the size of a cig). They ran up on this dude thinking he was with some other dude that was down the block writing graffiti. So they search him, thinking he's with this other dude, find the bat and bag him. He WASN'T with said other dude. Now I know for a fact he couldn't even get a res blast out of the damn thing, so can they really make a paraphernalia charge stick? Considering its seemingly an unlawful search? (pretty sure bag searches in new york city are completely legal, but dont think they can search your person without "reasonable cause" ???) Any tips appreciated, thanks in advance..
It would be thrown out in an instant if he got a lawyer. BUT, NYC police like every other state just wants money. He will just have to pay a fine and that's about it. There are a ton of ways to get the conviction dismissed but it wouldn't be worth it in lawyers fees. He could show up in court, say he had no weed, and was unlawfully searched and the judge may say to hell with it and dismiss it. i'd give it a try in court without a lawyer. See what happens. Really not a big deal though. Good luck
haha yea its sad but typical with this corrupt police state we live in. although the cops do more good than bad, there's still so much bad lol.
thats why people in Ny have 45's to put a slug in the cops face when they run up on them. Move to the projects and you should be strait.....
