Advice to those busted by cops...

    Never admit anything to a cop and Never take a plea bargain.

    It takes a L-O-N-G time to get a case thru the court system.

    Make sure your lawyer insists on viewing the evidence. MANY more times than you would think, the evidence has somehow gone missing by the time you get to court... No evidence, no case. :cheers2:

    Try reading it again. I said it all. 90% of the time folks take plea bargains rather than go to court. The cops scare them into it, the court appointed lawyers scare them into it. They WANT THAT CONVICTION! It makes their jobs a lot easier. And that's how they usually get a conviction. BUT, if you refuse to say you are guilty of anything, they might keep holding your case over for YEARS, until finally 1. The prosecutor tosses out the charges because it's gone on far too long, or 2. The "evidence" disappears from the evidence locker. This is FAR more common than you think. There are a lot more corrupt cops out there than you would imagine. Drugs are VALUABLE! Do you think that they want or even have room to store all that drug evidence for 2 or 3 (or more) years? The odds of evidence going missing, cops messing up paperwork, or cops simply NOT REMEMBERING enough of what happened to be able to be convincing on the stand are very good. The court system has LOTS of rules, and the longer the case goes on, the better the odds that SOMEONE in the system will make mistakes.

    And as a side note, have you ever heard of jury nullification? Because if you take your case all the way "to the box" it gives you PLENTY of time to educate your "peers" as to what it is. In a nutshell, if folks on the jury believe that the actual laws are WRONG that you are being accused of breaking, they DO NOT have to find you guilty if they don't want to!

    I'm not talkin' out my ass here. I've seen things like what I'm talking about happen regularly. And if EVERYONE refused plea bargains and went to the box, the court system would completely crumble! Remember, far more folks are busted for drugs than are arrested for violent crime, and there IS power in numbers.

    The only real way to get out of a busted situation is to be chill as fuck with the cop. Act like the cop is one of your best fucking friends, respect the hell out of them and you might just get away with verbal warnings. Don't get me wrong though, there are tons of cops out there that get their giggles from fucking with kids, so don't be mad when it doesn't work.

    Earthmother is giving good advice. I was popped with an lb and eventually walked because my lawyer got the evedence thrown out on some kind of complicated chain of custody argument. They offered to basically let me off if I would turn bitch, But I stood tall kept my mouth shut and eventually won. The reality is that unless you get caught with serious weight, or a gun/coke/meth/heroin they are only interested in your case to boost their stats or make you a rat.

    Absolutely. Some of these youngers don't get it, but I'm tellin' straight. I know quite a few folks in this tiny county of 7300 people and in the neighboring county who simply got "jacked" for their drugs or weed. The cops took in weed, guns, money, all sorts of stuff. Several cases. All the evidence went missing. Cops caught lying on the stand. Cops tampering with the jury, cops tampering with evidence, cops caught lying to the judge and the magistrate...

    AND one guy got his lawyer to get all charges tossed due to a technicality about there being NO PROBABLE CAUSE to get the warrant in the first place. Dude actually had 7 OZ. of weed.....

    AND one guy had his case in the system for 5 years so far. His lawyer says lookin' good for having charges tossed...

    Best advice is to never even talk to the cop if you know you gona get busted and more than a warning. Better yet, if you have to say anything write it down on a piece of paper and show it to him. That way you can later discard it if needed so it doesn't get used against you in court, and if it will help your case, you have proof of the conversation. And never sign anything the police present you with, they are considered a corporation, and in signing anything you are entering into a contract with them, so sign absoloutley nothing and say absoloutley nothing.

    Good advice earth mother.What part of the great state of Weat Virginia are you from?I'm from mercer county but stuck in the commenwealth of Virginia for the moment.I know what you mean by corrupt cops a "friend" of mine used to buy off several cops they would show up in their uni's and all.It's a hard life around here all the poverty and all everybody has got to do a little something on the side.I've lived all over and west v. is like no other place.Let's hope it stays that way.

    well around here i have seen in my experience with the juvenille system that it takes about a month before intake (it took about 6 weeks for me) and once at intake if its a simple possession charge or paraphanalia(sp?), and if u plead guilty u will be given something thats like probation for 6 months, with a monthly drug test. now while on this if u show them u have cleaned up your act (got a job, show up for school or get enrolled in a ged program, passed all your drug tests) you can get off in 3. now if u fail ur drug tests, you will be scheduled for actual court, go before the judge and be given probation for 6 months to a year and most likely ordered to attend na meetings or outpatient rehab(as happened to me). now if u plead not guilty you will be scheduled for court a month or two later and given probation for 6 months.

    this is all my knowledge on the court system threw mine and my friends dealings with it, but it seems to get the whole thing over with quicker if u just plead guilty, stay out trouble and get off the probation like thing (blanking in the name) in 3 months

    last time i talked to a cop i was scared and stoned... fuckin blew it.

    next time ima hold my own and see where it takes me.

    i got busted tuesday....i wouldnt say a word just said i wanted to se my lawyer....read my other post for more info.
