Can they search you if they were called on a noise violation? I think they would have to prove reasonable cause to search your person no matter where your person is standing. And why would 5 REAL cops come to your room for noise? Wouldnt campus security be doing that? I think there is some left out info here.
Ehhh it's looking decent for me on the judicial side of things... Talked to a few lawyers and they're all saying illegal search and seizure is quite likely to work. From the academic side of things, however, I'm looking at the end of my college career =/.
Got kicked out of campus housing. They're giving me 24 hours to find a place to live and move out. After 5 pm tomorrow I'm trespassing and subject to arrest. Nice
i dont think its illegal, seeing as you are on probation and they have the right to search you whenever they want when your on proby
Legal isnt the right word, I live in MA. What they did was decriminalize upto an ounce, so you get a ticket. However, laws about selling, using while driving, school zones, etc. all are still the same. The law wont be put into effect until the end of Dec. im waiting for that one...:toetap05:
besides that, you're fucked and prepare to do a couple of months in county jail. anywhere from 1-6 probably, depending on what you take a plea for. around 6 if you plea to Intent to sell, and 1-2 if they offer a plea on just the possension. The whole thing that fucks your case up is that, like me, you were on probation at the time. That means you can be subject to random searches whenever they want, not just when probable cause is established. What sucks even more is that first you will serve time for the actual arrest, and after you serve your sentence, then you will be charged with a VOP, or a Violation of Probation, and serve a little more time. But in total I dont expect it to pass a combined 6 months or so. How much weed did they find?
Well, at least if he goes away, and they Violate him, once He is out of Jail after the Violation he will be off of probation. most likely anyways.
well unfortunately a college is a school zone.drugs are illegal in a school zone no matter what,even if you have the "legal" ounce on you its illegal. but up where you are my friends mother is a judge for that county.she voted for decriminilizing weed.as well as most of the judges in that county.most of the MA. judges are sick of dealing with weed cases.they would rather just give you a fine,take your bag and send you on your way.and these are the exact words from a judges mouth.you may get lucky depending on how much they found. being homeless sux,i know as im homeless myself.except i have a friend that lets me stay in a camper in his yard.i dont have water or heat but i got electricity to run a little electric heater.let me tell ya,its fuckin cold out there!!!its even worse when you dont have any money.

Wow people need to show some basic human compassion . . . this thread shocked me tbh. The freaking guy is going to jail and the only dumb thing he was doing was messing with marijuana while on probation. Take a chill pill before you make fun of someone who's life has just been ruined.
If they said it was for a noise complaint why can they search you? Did they read you your rights? If not it can be thrown out. The only way they could have used a key is if they were going through the school so thats no good. Them telling you to shut up is great, you could maybe go with some form of police brutality.
If u were caught with less than one oz it is a cival offence that carries a $100 fine in Mass as of November 08. Good Luck
