Okay, basically, I live in a house in New Hampshire, with 5 people. Three of them smoke pot, and two of them hate the fact that pot is being used in the house since they want to be future educators. I'm one of the smokers and my fiance is one of the non-smokers. She also happens to be the legal manager of the house. The smokers think that only the person owning the weed would be liable, but the non-smokers think that the whole house would be held liable and since they're pursuing education careers, they would be ruined. Basically, I cannot find any laws whatsoever that state that if someone in the house is busted with possession or if cops find pot in the house, the whole house would be held liable. Who is legally correct in this manner? Even though I smoke, I just want what's best for my fiance, and if banning pot in the house will keep her record from possibly getting tarnished, then so be it.
In cases of a vehicle search that yields drugs that no one will claim, the police can charge everyone in the vehicle. Normally they will use common sense to place the drugs with the person sitting in that area of the car. For a home I cannot imagine them charging everyone in the house. First, why would the police enter your home? If you keep your marijuana in your room then there would be no reason for the police to charge anyone else. A simple possession charge is not going to ruin their career anyways. Your roommates are being paranoid. Confine the smoking to your individual room and don't do anything stupid that wold give the police the right to enter your home.
NH is pretty strict with their pot laws. Possession of any amount of marijuana is a misdemeanor and is punishable by up to one year in jail and a fine up to $2,000. As long as if for whatever reason the police were in your house and found the pot, as long as whoever owns it says they own it then noone else should be charged. Plus if they dont smoke they could volintarily take a drug test and say look I am clean, why would I have pot?
if no one was to take blame for the marijuana and its paraphanelia.. then the home owner is at charge.. if you're renting.. then everyone can be charged
well why would a cop be searching your house to begin with? It's not like they think you're selling out of your house or something..And as long as you have a small amount it wont be any worse than a misdemeanor.
