Soo today i was walking to my friends house with him after school and on the way we met up with our friends {lets call the k,r,and m so k had cigs so we were like ya lets go smoke a cig and we walked OFF of school proerty and went and smoked so while we where smoking in what we call the "smoke hole" all of the sudden 2 cop cars run up behind us and another runs up on foot in front of us. So the y unded up searching us WITHOUT consent and took down our names and stuff but by them seeing us smoke cigs does that give them a right to search us and they only saw "r" smoking the cig. but what i thought was funny thatk who is a girl hid the pack of cigs on in her waistband but they didnt even search her they searched the four guys who were there including me. all they got away with though was a torch lighter and 1 cig. But did that give them enough "probable cause " to search me ?
if yall are under 18 and smoking (breaking the law)yes they had the right to search you even if only one was smoking (guilty by association). if it was all male officers that is why they didnt search the girl. they are not allowed .
oh thanks you well the cop that was searching us was pretty cool even told my friend "thats what she said " after he said "this sucks ass " ha all we got was a warning though so it wasnt that bad
That's a load of garbage. I live in NY, and people down to 14 walk in front of cops all day smoking cigarettes, with no problem. That sucks that that happened. I did look something along the lines of this up once, and I'm not entirely sure but I do recall something along the lines of only being unable to buy (or recieve, i guess) tobacco products if under 18 (although not a crime to posess or smoke), and the only crime is in adults giving tobacco to poeple under 18. I may not be correct though, and hippyhillbilly did say that it was illegal... Oh well, all I know is that there aren't any problems where I live, and that's trashy that you all got caught up in that mess. EDIT: Just saw this again today and wanted to clarify, when I said "load of garbage" I didn't mean as in somebody's post I meant as in the fact that you guys got busted and how much that sucks. Just wanted to clarify.
Also, being within a certain distance of a school may give them even further reason to bust your ass. (no tobacco zones)
oh ya i live in oklahoma must be different in NY because they did get a call but i didnt get in any trouble it was just a hassle and my friends sold 2 dimes almost 10 minutes before that so we got pretty lucky hha
solve the problem from bottom up: stop smoking cigs. once you get out of high school you'll realize smoking cigs is about as uncool as masturbating to midget porn. second, i'm no lawyer obviously, but i'm pretty certain they don't need a warrant to check your pockets. they can rationalize this by saying they were doing a routine check for weapons. if they were searching your school bag that would be a different can of worms. every situation is different though so it's tough for people to judge here.
wow well i wasnt one of the ones smoking cigs and if i was your nones daddy to be telling me what to do anyways and they did search our bags and even made us take off our shoes and everything it was pretty stupid. and they looked threw my black book { i do graffiti if you dont know what a blackbook is} and even took pics of it but im not to worried about it anymore

i'm not trying to be your dad. but your dad would be right. i've never talked to any 30 yr old who is proud of the fact that they are addicted to cigarettes. not trying to criticize, just giving advice. take it or not, it's your life.
yeah that "no tobacco in school" rule is total bullshit. i'm a senior, 18 years old, and i smoke. why should i have to sneak my cigarettes around school? i always leave grounds before i light up, and it's not like i'm handing them out to freshman trying to get them addicted. but anyway, it's good that none of you had weed or anything. could have turned out tons worse.
Lol they cant even take your cig away, at least where i live... Its illegal to give tobacco products to minors but its not illegal for minors to posses them. Also at my school your allowed to have cigs as long as you go to the designated smoking sections to smoke them (but noone ever does)... But anyway that sucks someone got their torch confiscated i love thos elighters
