I just got back from seeing my Probation Officer, and he refused to see me because 'I smelled like patchouli oil'.This is the SECOND time this has happened to me by the same guy.

The first time, yes I was wearing it.He made me take a UA,and it came back clean.Yesterday,I went in I wasnt EVEN wearing any.(it was residual left over on my jacket) and he walked right out to me in the waiting room, handed me a a card, said,'Your wearing patchouli oil,and I am not going to see you'.

I said, but Im not wearing any?Its my coat,(mind you,it was 6 months at ago at LEAST that I had put some on there),this is the only coat I have (its a leather jacket, semi expensive) and Im not going to leave it out side!,Furthermore,I am in compliance with everything you asked of me' and he said.'we will discuss this next week'.

Ok,yeah,I got busted for possesion of marijuana, and dui.Im not some hardened purse snatcher or rapist.

So,Im asking what kind of recourse can I take, legally if any (ie file a complaint ect) ( I am also legally disabled,I have no drivers license,at it takes me a full three hour trip just to go see this guy as it is)

What's wrong with Patchouli oil, why should he care if you have some on, it's not illegal or anything?

their game is one of dis-empowerment. don't fall for that shit. ask for a different officer and explain your situation. take it as far as you need to take it to get a fair treatment. ask for his supervisor! patchouli oil is a legal substance. he can't refuse to see you for wearing it, and it is not probable cause for suspicion of marijuana use.

he is trying to break your personality and make you second-guess all of your decisions and all of your value systems. all of them!!!

it's a bullshit game. to some degree you've gotta play along and let them think they are winning. it is a game. play to win.

you are better than they are because you are capable of thinking for yourself. they are not.

carry some patchouli oil up your sleeve or something and "accidentilly" spill it on the dude next time you go in. That'll piss him off good.

Patchouli oil is awesome! Point out that it is no different than cologne, aftershave or perfume. Its just an oil based scent. He has no legal basis to refuse to see you or stop making you wear patchouli oil. I use patchouli. The little ol lady that is the greeter at church always gives me a hug when I walk in and tells me that she "likes my cologne".(the young ladies seem to like it too ;-) ).

I love the smell of petouli, its a very peaceful, friendly scent. Your parole officer must be a pretty cold hearted bastard not to let you wear it. id suggest getting to know his co-workers and if they dunt like him give them all some petouli to wear to work :)

Why would he even refuse to see you because of that? What's the point?

I dont know..apparently what happens is,soon as I walk in the office, the people at the front desk notify him that "Im wearing patchouli oil" and it 'makes them sick'.

HAHA I am going to take some with me next time, and have a small 'spill' :) somewhere in their office

To these ignorant clones, patchouli oil is equivilant to "tree hugger". And he's acting on his hositilty toward that way of life. Unconstitutional, but that's a word used quite often these days.

Creating a spill is not likely to help you at ALL...however this is unjust, ask to see the sergeant in charge of the parole area, if this does not QUICKLY resolve your problem then contact the public defenders office and let them know that you are having a problem, the last thing you need is to get busted for 'missing a parole check in or whatever'

Oh man, I'll talk to my mom about this one. In the fifth grade (yes, I was 10) my teacher pulled me out of class and told me I smelled like Marijuana and that I was to wash my jean jacket before D.A.R.E class the next day when the Cop would come in and tell us not to smoke weed and drink and whatnot. Yeah. Okay. I never smoked any pot, and when I got home and told my mom - she was furious. She wears patchouli and she said the smell must have rubbed off on me when she gave me hugs each day before school... or just the fact that I lived in the house, and the house had that smell... anyway, my mom was so mad because I asked, "Well why would she think it was marijuana?" and my mom replied, "Because it smells like Marijuana to people who don't know what marijuana smells like." and she wrote a big letter to the teacher..

Anyway, she's now a lawyer and I'm sure she'd be happy to answer this question... it's five minutes to 4am right now though so I'll ask her later ;)

My sister is a judge, and while she said that the officer can tell you the smell makes him sick and ask you not to wear it, he cannot refuse to see you because you are wearing it, or as you said it's in your jacket lining. You need to see his supervisor about this, and explain the situation. Unfortunately he's pulling a power trip on you, more than likely because of your appearance(you did say long hair and tatoos, right?) and while it's not fair,it happens. My husbands hair is past his shoulders, he's a musician and fairly recognizable. He does a lot of charity performances and has even played for the policemans ball(hey the money was good) however he was in my car one day going to the airport and a sheriff deputy stopped him and seeing clothes and bags in the back had the balls to ask him if he lived in his car. This officer knew who my husband was yet had the authority to pull him over and ask such an asinine question. My sis says while its not fair they do it anyway, but that yu should talk to someone about it.
