So I just found out today that my former science teacher in highschool got busted with growing 34 plants in his basement. I used to always get real baked and then go to chemistry class and he was cool with it. I was fucking excited to hear he was into pot but sad that all his work is thrown away and he is getting charged for it. But I don't think it will hold up in court, here is the situation: He was not home and all of the doors were locked, the cop was responding to his house to see if he was at home. They entered his house through the window and claim that they thought he needed medical attention then discovered a strong odor once inside and went down to the basement. So can he still get charged??? They had no right to go into his home it was completely locked up and he wasn't even there. Fuck those small town cops! Peace
Why did they believe he needed medical attention if he wasn't even home? The responding officer wasn't exactly in the wrong but the cultivation charges should be thrown out. Depending on the judge, they may try to plea bargain him if his lawyer isn't smart enough to find a technicality to get it dropped.
They said they believed he needed medical attention as their excuse to go inside the home. His employer called the local sheriffs office expressing concern for him because he didn't show up at work that day, so an officer was sent out to his house to check up on him and then illegally entered his home. It is small town living. The point is, he wasn't at home, they didn't have a warrant, and they broke in. I don't see how this is legal...
Thats fucked I don't really know all of the laws and all the loops but it just doesn't seem right at all man.
Yeah I know I feel the same man. Especially since the guy isn't a criminal at all. He was my highschool science teacher, I knew him personally enough to know he is a pretty good guy. Did horse shoeing for a side business when he was still teaching...nothing bad about him. I just love the fact he grows weed
Its entirely possible if the company called in and expressed their concerns the cops might get worried and check for medical emergency.. It will most likely get thrown out but theres a chance that it wont
This. They just entered because they thought he was dying or something inside, so it'll likely be thrown out.
i would love to have this guy as my chemistry teacher. and thats weak how they just broke into his house like that, but they will always have some excuse to get away with it... their the law -_-
All the science teachers I've had through highschool have been into drugs especially marijuana. Sucks this guy could go down for some bullshit like that. Hope its dropped.
bummer for the teacher. 34 plants is a hell of a grow op though. he'd have a hard time arguing it was all for 'personal' use, and as a school teacher, i suspect that no one but a very liberal judge will let that go. if it were maybe a plant or two he could get away with it. sucks either way...keep this thread updated as to what happens. is there a news article on it anywhere online??
that was illegal entry by the police. unless the owner of the house let them in himself they had no business going in unauthorized. which could easily lead the case to a dismissal because of personal rights violations and obviously illegal search and seizure...they still take away his pot though
