when i get high i like to smoke inside a house or some area in which i know i have no chance of getting caught (at least by the police ). however i was curious if a cop knows you are high and searches you but finds no drugs or paraphernalia, what would they be able to do to you? keep in mind this is all assuming the cops aren't willing to break the law themselves just to get you on something.
they cant do shit. Unless you are on probation or something, and they do an intoxication test. Usually they just point their finger really close between your eyes and look and see if they bug out. That is, if you let yourself be stopped by the police. Police aren't gonna bother you if you aren't doing anything suspicious. or unless they're profiling you.
Some states have internal possession laws. You could also get a ticket for being intoxicated in public.
MarcoWasRight is pretty much correct. Public intox ain't so bad, however... Internal possession... Ouch... Just don't get public intox as an adult... I know somebody who's actually a dealer who got his stupid ass busted a ways back... Spent a few days in the clink.
this is not ture, if you are driving a car and are pulled over they can do a field soberity test to see if you are sober and if not they can give you a dui, if you are riding in a car unless your state has internal possession laws then you are fine assuming you have nothing on you, if you are walking down the street the cops may arrest you for public intoxication
"This just in: the entire human race was arrested for internal possession of the dangerous substance dimethyltryptamine, also known as DMT." I never knew such a law existed. I always thought you couldn't be arrested for being high.
dude unless youre driving something, they cant do anything at all..they cant even search you without reasonable suspicion
yeah cops knew i was high as hell because the dick i was with told him we were smoking. but he didnt do shit to me....cant be arrested for being high. it was even a dickhead cop.
I know you didn't just fucking say that. Don't say something you have no idea about, because you're wrong. You'll mislead people this way. A cop can have 100 reasonable suspicions and he still can't search you. It's probable cause that gives them the right to search you, not reasonable suspicion.
