I got pulled over after smoking in my car with three other people. I knew my car was good but I wasn't sure if they stashed anything inside whilst getting pulled over. Luckily this dumb bitch I was with stuck her shit in her purse and a guy I worked with ate the roach... Him and his girlfriend stayed cool as did I but unfortunately the dumb bitch admitted to the cop about smoking. I just shut up and didn't say anything. He searched our car for 2 hours, lectured me for being 17 and driving around smoking "fucking" dope and gave me a field sobriety test. I didn't give him consent to search my car but he said he smelt marijuana in my car, then just went through it. He got in my wallet and I said "Hey man that's my fucking wallet" and he told me that he could "do whatever he wanted." I mean they never even gave me a reason to pull me over.... it was crazy. He told me he could charge me with maintaining a common nuisance and being out past curfew but he didn't, apparently then I smiled and he changed his mind and told me too put my hands behind my back. I refused and he said you're so lucky I'm giving you this break and told me he would arrest me in a year and then called my dad. The dumb bitch went to jail and went too court but I don't give a damn about her. My parents know I smoke weed now, but there okay with it... I mean they have always known. It was my first time getting pulled over... I'm a lucky duck. also im high so this story isn't narrated well. peace -rydns
The officer "smelling" weed is not a good enough reason to search your car if you said clearly that you did not give consent he was in the wrong ina big way. but since you are a teen he assumed you would not know that. What he did is a huge violation of your rights, your car is private property he can not search it without a warrent or something in plain sight that would be incriminating IE a pipe or something, a smell is too subjective, that will not hold up in court. I made the same mistake when I was young and assumed an officer could search my car. He told me the same thing I smell drugs.
WRONG! Smell is probable cause but is very subjective. Is the car in your name? If the dumb bitch also told the officer previous to the search that she had been smoking then he would have even more reason to take a good whiff of your car. Did he find the weed on her previous to the search?
no he found it during the search in her purse... she admitted before he found it... the car is in my fathers name...
I'm not sure if this applies in every state but usually the owner determines whether or not the vehichle can be searched. Her admission along with the (suspected) smell was all he needed. If you had been driving carefully and were pulled over randomly then the dumb bitch is to blame. Police can put a lot of stress and pressure on people but doesn't everyone love to say "NO" to an authority figure anyways? If you have Grateful Dead stickers on your car and you violated a traffic law then you are to blame because it could have been avoided but it sounds like you did well. Police love to pull over people simply because of their race, car, or even bumper stickers. I still need to get an NRA sticker and a "Vote ----- for Sheriff" sticker.

i feel your pain man, was smoking in buddys car, one of them threw a bottle at a car, we got pulled over once cops found us ( there must have been a lookout, now the car is on a watch list becuase we have had more then 3 encounters with the car ) he said he smelled it and searched the car, found all the shit and we get fucked
I feel the shittiness of the situation. It really is a pain in the ass, and even if you didn't get in trouble, you feel like you got a pigs dick in your ass. Anyway, I would suggest not smoking in a car. You give up so many of the rights that you have in on private property. Probable cause can be as subjective and undocumented as "smell of mj" or "blood shot eyes". At least in a house, they have to have a warrant or witness you smoking or doing something illegal. If you are out and about, you should find a place outdoors because you can conceal things more easily and you at least won't get your car impounded/ticketed/towed. Glad to hear you got off easy
